First-time red books are issued incorrectly, where do people go to correct them
According to the provisions of Decision 2304/QD-BTNMT and the 2024 Land Law, in case the red book of land in rural areas when issued for the first time has errors, the information correction will be done by the People's Committee at the commune level or the Branch of the Land Registration Office.
In case the land is in an urban area or has a book issued by the province, the people must submit the application directly to the Branch of the Land Registration Office. This place is responsible for reviewing, editing incorrect information on the red book and reissuing the correct book to the people.
Procedures for correcting red books when there are errors
When discovering that the red book has incorrect information, the land user needs to prepare a dossier to request correction. The dossier includes:
Application for registration of changes in land and assets attached to land (according to Form No. 11/DK issued with Decree 101/2024/ND-CP).
Original Certificate of Land Use Rights.
Documents proving the content is incorrect.
Authorization document (if implemented through a representative).
The application is submitted to the One-stop Department or the Land Registration Office. After receiving the application, the competent authority checked the application, determined the cause of the error and proceeded to correct and reissue the red book according to regulations.
Cost of correcting red books
In case the red book has incorrect information due to the fault of the agency issuing the certificate or land users from poor households, people with disabilities, people with meritorious services to the revolution... will be exempted from fees.
If the mistake is caused by the land user, the re-issuance fee is regulated by the Provincial People's Council, usually ranging from 28,000 - 120,000 VND. At the same time, additional costs may arise for measuring and registering changes depending on the locality.
