The 2024 Land Law has many new points that benefit land users when the State reclaims land. Accordingly, from August 1, 2024, people will be rewarded when they hand over reclaimed land before the prescribed deadline.
This is one of the new points in the 2024 Land Law because the 2013 Land Law does not have a reward mechanism for people who hand over land earlier than the prescribed deadline.
This is specifically stipulated in Clause 7, Article 111 of the 2024 Land Law, which stipulates on this issue as follows:
- People whose residential land is recovered to implement urban construction investment projects will be compensated with residential land and on-site housing; while waiting for resettlement arrangement, they will be arranged to live in temporary housing or receive support for housing rental; the specific time and level of support will be determined by the Provincial People's Committee in accordance with local reality.
- In case of land recovery for other purposes, compensation will be made in the form of land and housing on site if there is a resettlement land fund or housing fund in the land recovery area.
- Priority is given to convenient locations for households and individuals using residential land in combination with business services, and those whose land is recovered are those who have contributed to the revolution. There is a reward mechanism for those whose land is recovered and who hand over the site before the deadline according to regulations of the Provincial People's Committee.
Accordingly, this regulation aims to encourage and motivate people whose land is recovered to hand over the site early, thereby speeding up the land recovery process. Each locality will have its own mechanism regulated by the provincial People's Committee, ensuring that the reward level is appropriate to the economic conditions and characteristics of each province.
