How much will be the fine for abandoning land under the new regulations?

The Government has just issued Decree 123/2024/ND-CP regulating administrative sanctions for violations in the land sector.

Specifically, Article 24 of Decree 123/2024/ND-CP stipulates administrative sanctions for the act of not using land for annual crops, land for aquaculture for 12 consecutive months, land for perennial crops for 18 consecutive months, land for forestry for 24 consecutive months, specifically:

1. The form and level of penalty for not using land for annual crop cultivation or aquaculture for 12 consecutive months is as follows:

- Fine from 2,000,000 VND to 5,000,000 VND for land area under 0.5 hectare.

- Fine from 5,000,000 VND to 10,000,000 VND for land area from 0.5 hectare to less than 1 hectare.

- Fine from 10,000,000 VND to 20,000,000 VND for land area from 1 hectare or more.

2. The form and level of penalty for not using land to grow perennial crops for 18 consecutive months is as follows:

- Fine from 2,000,000 VND to 5,000,000 VND for land area under 0.5 hectare.

- Fine from 5,000,000 VND to 10,000,000 VND for land area from 0.5 hectare to less than 1 hectare.

- Fine from 10,000,000 VND to 20,000,000 VND for land area from 1 hectare or more.

3. The form and level of penalty for not using forest land for 24 consecutive months is as follows:

- Fine from 3,000,000 VND to 5,000,000 VND for land area under 0.5 hectare.

- Fine from 5,000,000 VND to 10,000,000 VND for land area from 0.5 hectare to less than 1 hectare.

- Fine from 10,000,000 VND to 20,000,000 VND for land area from 1 hectare or more.

Note: This is the penalty applied to individuals who violate the law. For organizations that violate the law, the penalty is doubled (Clause 2, Article 5, Decree 123/2024/ND-CP)

In addition to administrative penalties, violators are also subject to the following remedial measures:

- Forcing land users to put land into use within 60 days for the following acts:

+ Do not use land for annual crops or aquaculture for 12 consecutive months.

+ Do not use land to grow perennial crops for 18 consecutive months.

- Forcing land users to put the land into use within 90 days for the act of not using land for afforestation within 24 consecutive months.
