On the Ministry of Construction's Information Portal, citizen D.Q reflected that according to Clause 2, Article 38 of Decree No. 100/2024/ND-CP, in case the project has a priority subject as prescribed in Point d, Clause 1, Article 79 of the Housing Law, it is allowed to buy social housing without having to draw a certain quota.
The number of apartments for these priority groups (not through drawing) is determined by the ratio between the total number of apartments of these 05 priority groups on the total number of registration documents for the total number of social housing apartments of the project.
The list of priority groups is arranged in order according to the time of application submission. Apartments for priority subjects are arranged in order of the Priority List until they are sold out, the remaining subjects are allowed to continue participating in the drawing (organized by the investor, with representatives of the Department of Construction and related units participating in supervision).
Accordingly, in this case, if individuals in the priority group are people with meritorious services to the revolution, relatives of martyrs who are eligible for housing improvement support according to the provisions of the Ordinance on Preferential Incentives for People with Meritorious Services to the Revolution (Clause 1, Article 76 of the Housing Law), they will be given priority first in the list of 5 priority groups, then go to the list in order according to the time of submitting the application to determine the subjects eligible for priority to buy social housing without having to draw with a certain percentage, is that correct?
Regarding this content, the Ministry of Construction responded as follows:
At point d, clause 1, Article 79 of the 2023 Housing Law, it is stipulated that:
In case a subject is entitled to many different support policies, he/she is entitled to the highest support policy; in case the subjects have the same standards and conditions, support will be implemented in order of priority for: People with revolutionary contributions, relatives of martyrs, people with disabilities, people who are resettled in the form of buying or renting social housing, women.
Clause 2, Article 38 of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing stipulates:
In case the project has a priority subject as prescribed in Point d, Clause 1, Article 79 of the Housing Law, it is given priority to buy, rent, and rent social housing without having to draw a certain ratio. The number of apartments (houses) for these priority groups (not through drawing) is determined by the ratio between the total number of records of these 05 priority groups on the total number of registration records multiplied by the total number of apartments (houses) for social housing of the project. The list of priority groups is arranged in order according to the time of application submission. Apartments for priority subjects are arranged in order of priority list until sold out, the remaining subjects are allowed to continue participating in the draw".
Based on the above regulations, the list of priority groups eligible to buy social housing without drawing is arranged in order according to the time of submission.
