Ca Mau voters proposed that the Ministry of Construction consider a mechanism for Ca Mau province to allow the construction of social housing as individual houses and apartments in accordance with actual conditions and construction planning of the locality to facilitate the implementation of calling for investment in developing social housing.
After studying, the Ministry of Construction would like to answer as follows:
During the process of researching, drafting and submitting to the National Assembly the draft Housing Law (amended), this content was also brought up for discussion.
Accordingly, with the goal of saving resources on land and investment costs, creating a spacious urban appearance, creating fairness among those who enjoy apartment and individual housing policies, the draft Law submitted by the Government stipulates that social housing is apartment.
However, to meet the practical needs and customs of some localities, the National Assembly Standing Committee has accepted the opinions of National Assembly deputies and added the following provisions: "In case a social housing project is invested in construction in a commune in an ethnic minority and mountainous area according to the regulations of the Prime Minister, individual houses will be built".
Therefore, Point a, Clause 1, Article 82 of the 2023 Housing Law stipulates the types of houses and standards for social housing area as follows: "Social housing is an apartment building, invested in and built according to a project, in accordance with the approved detailed construction plan. In case the social housing construction investment project is invested in construction in communes in ethnic minority and mountainous areas according to the regulations of the Prime Minister, individual houses can be built.
On June 4, 2021, the Prime Minister issued Decision No. 861/QD-TTg approving the list of communes in Region III, Region II, Region I in ethnic minority and mountainous areas for the period 2021-2025.
On July 19, 2024, the Prime Minister issued Decision No. 698/QD-TTg approving the adjustment, supplementation and validation of the list of communes in Region III, Region II, Region I in ethnic minority and mountainous areas for the period 2021-2025 (amending and supplementing a number of contents of Decision No. 861/QD-TTg).
In Decision No. 861/QD-TTg, there is a list of communes in ethnic minority and mountainous areas of Ca Mau province, classified according to the development level for the period 2021-2025.
Ca Mau before merging 6 communes (1 commune in area I; 5 communes in area III)
Bac Lieu before merging 14 communes (11 communes in area I; 3 communes in area II)
On November 15, 2025, the Ministry of Construction submitted Document No. 143/TTr-BXD to the Government on the proposal to issue a Government Resolution on a number of special mechanisms to handle difficulties and obstacles due to legal regulations on social housing development.
Accordingly, in Section 2.2 there is an assessment of the inadequacies and problems of the regulations on housing types at Point a, Clause 1, Article 82 of the Housing Law 2023.
On that basis, in Clause 2, Article 2 of the draft Resolution attached to Submission No. 143/TTr-BXD, the Ministry of Construction has proposed a provision: In centrally-run cities and areas within the administrative boundaries of provincial wards, investors of social housing construction investment projects must build social housing as apartment buildings.
For the remaining areas, the Provincial People's Committee, based on specific local conditions, shall submit to the Provincial People's Council regulations on areas where investors are allowed to invest in the construction of social housing and houses for the People's Armed Forces which are individual houses".
