On the Government Portal, Mr. K.A.T in Hanoi reported that his father is a retired cadre and receives allowances for resistance fighters infected with toxic chemicals.
Recently, in Mr. T's hometown (Ninh Binh), there have been a number of social housing projects, so is his father eligible for priority to buy social housing or not (no houses or land in the locality yet)?
The Ministry of Construction responds to this issue as follows:
Article 76 of the 2023 Housing Law stipulates the beneficiaries of social housing support policies:
"1. People with revolutionary contributions and relatives of martyrs who are eligible for support to improve their housing according to the provisions of the Ordinance on Incentives for People with Revolutionary contributions.
2. Poor and near-poor households in rural areas.
3. Poor and near-poor households in rural areas are often affected by natural disasters and climate change.
4. Poor and near-poor households in urban areas.
5. Low-income people in urban areas.
6. Workers and laborers working at enterprises, cooperatives, and cooperative unions inside and outside industrial parks.
7. Officers, professional soldiers, non-commissioned officers of the People's Armed Forces, police workers, civil servants, workers and defense officials serving in the army; people working in cryptography, people working in other cryptographic organizations receiving salaries from the state budget they are working for.
8. Cadres, civil servants and public employees according to the provisions of law on cadres, civil servants and public employees.
9. The subject has returned the public housing as prescribed in Clause 4, Article 125 of this Law, except in cases where the public housing is revoked due to violation of the provisions of this Law.
10. Households and individuals whose land is recovered and whose houses must be cleared or demolished according to the provisions of law and have not been compensated by the State with houses and residential land.
11. Students studying at universities, academies, colleges, vocational schools, and specialized schools as prescribed by law; students studying at public ethnic boarding schools.
12. Enterprises, cooperatives, and cooperative unions in industrial parks".
At Point d, Clause 1, Article 79 of the 2023 Housing Law, it is stipulated that the principles for implementing social housing support policies:
"d)... in case the subjects have the same standards and conditions, support will be implemented in order of priority for: people with revolutionary contributions, relatives of martyrs, people with disabilities, people who are arranged for resettlement in the form of buying or renting social housing, women".
The Ministry of Construction recommends that citizens base on the above regulations to compare with specific cases of the family.
