Citizen N.M.H in Hanoi asked about the procedures for purchasing social housing according to the provisions of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government and Circular No. 05/2024/TT-BXD dated July 31, 2024 of the Minister of Construction.
After studying, the Department of Housing and Real Estate Market Management gave the following opinion:
Clause 4, Article 3 of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing stipulates: "The low-income subjects specified in Clause 5, Article 76 of the Housing Law are those with the income level prescribed in Article 30 of this Decree".
At Point d, Clause 1, Article 38 of Decree No. 100/2024/ND-CP stipulates: After collecting all the registration documents of the subjects in need, the investor of a social housing construction investment project is responsible for reviewing each registration dossier, comparing the regulations on subjects and conditions according to the provisions of Articles 76 and 78 of the Housing Law, document models according to the instructions of the Minister of Construction, the Minister of National Defense and the Minister of Public Security to make a List of subjects eligible to buy social housing in the project of which he is the investor.
On July 31, 2024, the Ministry of Construction issued Circular No. 05/2024/TTBXD of the Minister of Construction detailing a number of articles of the Housing Law, accordingly, in Form No. 01 of Appendix I of the Circular, documents proving the beneficiaries of social housing support policies have been instructed. In case the declarant has retired from the regime (retired), the agency, unit, or enterprise issuing the Decision on retirement from the regime of that person is responsible for confirming the income according to the pension level paid by the Social Insurance agency according to Form No. 01, Appendix I of Circular No. 05/2024/TT-BXD.
The above is the opinion of the Department of Housing and Real Estate Market Management regarding the content of procedures for purchasing social housing according to the provisions of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government and Circular No. 05/2024/TT-BXD dated July 31, 2024 of the Minister of Construction, requesting citizens to base on the above regulations to comply with the provisions of law.
