Readers reflected that for the procedure for reissuing the Land Use Rights Certificate due to loss, readers hope that the competent authority will guide specific procedures and processing time for people to carry out the procedures to request reissuance of the lost Land Use Rights Certificate in accordance with legal regulations.
Responding to the above content, the Ministry of Agriculture and Environment said that the order and procedures for reissuing the Land Use Rights Certificate issued due to loss are stipulated in Section VIII, Part C, Appendix I issued with Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government, regulating the division of authority of local authorities at 2 levels, decentralization and delegation in the land sector;
Procedures No. 8 are in Part B; Provincial administrative procedures are announced in Decision No. 2304/QD-BNNMT dated June 23, 2025 of the Minister of Agriculture and Environment.
The above procedures do not stipulate the procedures for the Land Registration Office, the Land Registration Office Branch requires the People's Committees at the commune level to send verification documents to credit institutions and financial companies to verify whether the land use right is mortgaged or not.
The Land Registration Office, Branch of the Land Registration Office shall check information about the issued Certificate that the land user or owner of property attached to the land declared lost in the cadastral records and land database as prescribed in Point a and Point b, Clause 2, Section VIII, Part C, Appendix I issued with Decree No. 151/2025/ND-CP.
The deadline for handling procedures is no more than 10 working days, not including the time for posting the notice of loss of the Certificate issued to the People's Committee at the commune level, the time for posting on mass media as prescribed in Clause 5, Section II, Part C, Appendix I issued with Decree No. 151/2025/ND-CP.
