Regulations on rural residential land
Article 195 of the 2024 Land Law stipulates rural residential land as follows:
- Rural residential land is land used for housing and other living needs in the same plot of land in rural areas.
- The People's Committee (UBND) at the provincial level stipulates the limit of land allocation for individuals in rural areas, based on land fund and actual situation of the locality.
- Rural residential land must be arranged synchronously with land used for the purpose of building public works, public works, ensuring convenience for production, people's lives, environmental sanitation and in the direction of rural modernization.
- The State has policies to create conditions for people in rural areas to have housing on the basis of land use in existing residential areas, limiting the expansion of residential areas on agricultural land.
Minimum area for land division for rural land
The People's Committees of provinces and cities will rely on the actual situation and land fund of each locality to regulate the residential land limit for individuals in rural areas.
For example:
- In Hanoi, the limit for residential land allocation to individuals in urban and rural areas is at least 50m2 (according to Decision 61/2024/QD-UBND).

- In Ho Chi Minh City, newly formed land plots and remaining land plots after division (except for the area under the traffic construction planning) must ensure a minimum area according to Decision 100/2024/QD-UBND.

- In Hai Phong, according to Decision 31/2024/QD-UBND dated October 26, 2024, the minimum area for dividing plots in rural areas is 60m2. The newly formed land plot must have a minimum width of 4m adjacent to a traffic road or walkway, a minimum depth of 4m and ensure that the cross-section in the narrowest part of the land plot is not less than 3.5m.
