Recently, Chairman of Cao Bang Provincial People's Committee Hoang Xuan Anh signed Decision No. 43/2024/QD-UBND on stipulating a number of criteria and conditions for converting land use purposes under 2 hectares for rice-growing land, protective forest land, production forest land, and special-use forest land to other purposes in Cao Bang province.
Accordingly, the conversion of land use purposes of the above types of land must ensure 6 conditions and criteria.
First, the conversion must be consistent with the district-level land use plan. For Cao Bang City, it must be consistent with the district-level land use plan or general plan, or possibly the zoning plan.
Next, the entity wishing to convert land must have an investment decision, investment policy approval or investor approval according to the provisions of law.
In cases not subject to investment policy approval or investor approval under investment law, the conversion must be consistent with the annual land use plan of the district level.
When converting the purpose of using the above types of land, the subject must have a plan for alternative forestation or complete a document to pay for alternative forestation. There must be a plan for using the topsoil layer according to the provisions of the law on cultivation.
Finally, to complete the conversion process, the subjects will have to fully implement the procedures in the environmental field of environmental protection law.
The implementation of these procedures will be chaired by the Department of Natural Resources and Environment of Cao Bang province, coordinated by the Department of Agriculture and Rural Development and relevant departments.
As for the People's Committees of districts and communes, they must be responsible before the law for the accuracy of the area, location, and type of land that needs to be converted to another purpose. They must closely monitor and supervise the process of converting land use purposes to ensure compliance with legal regulations.
According to the content of the document, Decision No. 43/2024/QD-UBND will take effect from October 24, 2024.
On October 21, speaking with reporters, Mr. Vu Van Tuan - the owner of a business operating in the area - said: "I think this new regulation is very good. Cao Bang is a province with a lot of forest land, when there are clear regulations, it will be easier for businesses to convert the purpose of land and warehouses for business."
