Violations of auction, authorities must organize review
On September 5, Ms. Phu Thi Minh Thue (residing in Nha Trang City) said that she had received a notice of conclusion from the Chairman of Khanh Hoa Provincial People's Committee and a document from Nha Trang City People's Committee regarding her complaint to claim benefits in the land auction case 22 years ago.
In 2002, Nha Trang City People's Committee sold 2 auctioned lots of land use rights in Area II, Hon Nghe village, Vinh Ngoc commune to Ms. Phu Thi Minh Thue. However, these 2 lots overlapped with the land area that had not yet completed support and compensation procedures.
Afterwards, Khanh Hoa Provincial People's Court declared the land allocation decisions and land use right certificates granted to her null and void.
For many years, Ms. Phu Thi Minh Thue has requested that the People's Committee of Nha Trang City be responsible for compensating her family for damages and consider returning two plots of land corresponding to the plots that were confiscated.
After the meeting in February 2024, Chairman of Khanh Hoa Province Nguyen Tan Tuan requested the Chairman of Nha Trang City People's Committee to direct the inspection and review of the current planning and land use plan of the auctioned land; at the same time, inspect and review all documents related to the auctioned land in Hon Nghe village, Vinh Ngoc commune.
In addition, the Chairman of Khanh Hoa Province also requested the Chairman of Nha Trang City People's Committee to organize a review and handle responsibilities for organizations and individuals involved in violations in advising on land auctions that are not in accordance with regulations; and direct the Chairman of Vinh Ngoc Commune People's Committee to inspect the construction of houses in the auctioned land area.
Assign Nha Trang City People's Committee to instruct Ms. Phu Thi Minh Thue to file a lawsuit at the Court regarding the fact that she won the auction to buy land but did not receive the land, affecting her legitimate rights and interests according to the Law on State Compensation Liability.... Request Nha Trang City People's Committee to organize the implementation, and be responsible for protecting the legitimate rights and interests of citizens according to regulations.
No mention of review, just instructions for citizens to go to court
In a document sent to Ms. Phu Thi Minh Thue on August 23, 2024, Mr. Le Dai Duong - Vice Chairman of Nha Trang City People's Committee only quoted the announcement of Chairman of Khanh Hoa Provincial People's Committee Nguyen Tan Tuan with the content instructing Ms. Thue to file a lawsuit at the Court to consider compensation for damages of 2 land lots purchased at auction.
In addition, the citizen response document signed by Mr. Le Dai Duong did not mention the content of organizing a review and handling responsibilities for organizations and individuals involved in violations in advising on land auctions that are not in accordance with legal regulations.
Meanwhile, a representative of the People's Committee of Vinh Ngoc commune informed that the case of Ms. Phu Thi Minh Thue winning the auction of 2 land lots in Area II, Hon Nghe village, Vinh Ngoc commune has been going on for a long time.
Currently, the relevant officials are either retired or dead. Therefore, guiding citizens to file a lawsuit in court is a way for the state management agency to have a basis to resolve and arrange 2 other suitable plots of land.
