On October 1, the People's Committee of Khanh Hoa province announced that it had issued a document on extending land use for land-using organizations whose land use term expired before August 1, 2024.
Currently, the 2024 Land Law and the Government's Decrees guiding the implementation of the Land Law take effect from August 1, 2024. The new effective law has provisions on handling cases of land-using organizations whose land use term has expired before August 1, 2024.
According to the above regulations, within 6 months from August 1, in cases where organizations using land in the area have expired land use term but the State has not yet reclaimed the land, they must submit documents to carry out procedures to extend land use term according to regulations.
Khanh Hoa province notifies land-using organizations to self-review land use duration and submit application for extension procedures.
Regarding the new regulations, in August, Khanh Hoa province canceled 4 decisions on land prices for real estate projects.
These are Decisions No. 2116, No. 2133, No. 2151, No. 2161 in August 2024.
The above decisions include the approval of specific land prices to calculate additional land use fees due to adjustments to the architectural planning scheme of the Napoleon Castle I Apartment project at 25-26 Nguyen Dinh Chieu, approval of specific land prices to calculate land use fees and land rent for the Le Hong Phong II New Urban Area project, Phuoc Long New Urban Area, and approval of specific land prices to calculate land rent and annual land rent payments at the land plot at 2 Yersin Street.
The reason for canceling the above decisions is because the decisions issued based on legal documents have expired.
In addition, in 4 decisions (before being canceled) approving specific land prices of the Provincial People's Committee issued after August 1, 2024 (draft of the Department of Natural Resources and Environment submitted for signing before August 1, 2024), but in the legal basis for issuing the decision, the 2013 Land Law and the decrees and circulars guiding its implementation have expired since August 1, 2024 are inappropriate and should be canceled.
