According to the provisions of Article 27 of the 2020 Residence Law on conditions for temporary residence registration as follows:
Article 27. Conditions for temporary residence registration
1. Citizens who come to live legally outside the scope of the commune-level administrative unit where they have registered their permanent residence for work, study or for other purposes for 30 days or more must register for temporary residence.
2. The maximum temporary residence period is 2 years and can continue to be extended many times
3. Citizens are not allowed to register for new temporary residence at the place of residence as prescribed in Article 23 of this Law.
Accordingly, for citizens who go to another place outside the scope of the commune-level administrative unit where they have registered their permanent residence for work, study or for other purposes for 30 days or more, they must register for temporary residence and the maximum temporary residence period is 2 years.
Pursuant to the provisions of Clause 1, Article 9 of Decree 144/2021/ND-CP on temporary residence extension as follows:
Article 9. Violating regulations on registration and management of residence
1. Fine from VND 500,000 to VND 1,000,000 for one of the following acts:
a) Failure to comply with regulations on permanent registration, temporary residence registration, cancellation of permanent residence registration, separation of households or adjustment of residence information in the Residence Database.
b) Failure to comply with regulations on accommodation notices and temporary absence declarations.
c) Not presenting household registration books, temporary residence books, confirmation of residence information, and other documents related to residence as required by competent authorities.
Accordingly, even if living at a relative's house, when living in another locality for more than 30 days where they have permanent residence, citizens must still register for temporary residence so that the competent authority can manage their residence.
If citizens do not register for temporary residence while living at relatives' houses, they will be fined from VND 500,000 to VND 1,000,000.
