Application for reissuance of lost red book
Land users and owners of assets attached to land submit applications for registration of changes in land and assets attached to land according to Form No. 11/DK issued with Decree 101/2024/ND-CP to one of the agencies receiving the application.
- One-stop-shop department according to regulations of the Provincial People's Committee on receiving dossiers and returning results of administrative procedure settlement at provincial, district and commune levels.
- Land registration office or branch of Land registration office.
Procedures for reissuing lost red book
Step 1: Submit application for reissuance of lost red book.
Step 2: The land registration office performs the following tasks:
- Check information about the issued red book that has been declared lost in the land records and land database.
- If the red book is found to have been transferred for use, or mortgaged at credit institutions, economic organizations, or individuals, then the file will be returned.
- If not falling under the above cases, the land registration office shall transfer the information to the People's Committee of the commune where the land is located; publish the information 3 times in the local mass media within 15 days about the loss of the issued red book for organizations and people of Vietnamese origin residing abroad, the cost of publishing the information shall be paid by the land user and owner of the property attached to the land.
- Cancellation of issued red books, update and edit land records.
Step 3: Reissue the red book with updated information of the issued red book and information on the Additional Page.
Cost of reissuing lost red book
Depending on the locality and the provincial People's Council (PC), each place will have a fee for re-issuing a red book (according to Clause 2, Article 5, Circular 85/2019/TT-BTC).
"Basis for determining fee and charge levels: "Based on socio-economic conditions in the locality where service provision and fee and charge activities arise, the Provincial People's Council shall prescribe appropriate fee and charge levels.
Fees for granting certificates of land use rights, house ownership rights, and assets attached to land are the fees that organizations, households, and individuals must pay when being granted certificates of land use rights, house ownership rights, and assets attached to land by competent state agencies.
Fees for granting certificates of land use rights, house ownership rights, and assets attached to land include: Granting certificates of land use rights, house ownership rights, and assets attached to land; certificates of land change registration; extracts of cadastral maps; documents; cadastral records data.
Based on specific local conditions and local socio-economic development policies, appropriate fee collection levels are prescribed, ensuring the following principles: Collection levels for households and individuals in districts of centrally-run cities, inner-city wards of cities or towns under provinces are higher than collection levels in other areas; collection levels for organizations are higher than collection levels for households and individuals.
