Pursuant to the provisions of Clause 7, Article 16 of Decree 16/2022/ND-CP:
Penalties for the act of organizing construction without a construction permit but according to regulations must have a construction permit as follows:
a) Fine from VND 60,000,000 to VND 80,000,000 for individual house construction.
b) Fine from VND 80,000,000 to VND 100,000,000 for the construction of individual houses in conservation areas, historical - cultural relic sites or other construction works.
c) Fine from VND 120,000,000 to VND 140,000,000 for construction works requiring a feasibility study report for construction investment or works requiring an economic - technical report for construction investment.
According to the above regulations, the penalty for building a house without a construction permit is as follows:
- Fine from VND 60,000,000 to VND 80,000,000 for individual house construction;
- Fine from 80,000,000 VND to 100,000,000 VND for building individual houses in conservation areas, historical - cultural relics or other construction works.
Note:
- The above fine is the fine applied to the organization. For the same administrative violation, the fine for individuals is equal to 1/2 of the fine for organizations (Point c, Clause 3, Article 4, Decree 16/2022/ND-CP)
- The above behavior while constructing, in addition to being fined according to regulations, must also follow the order and procedures prescribed in Article 81 of Decree 16/2022/ND-CP (Clause 16, Article 16 of Decree 16/2022/ND-CP).
