The Government Office has just issued a conclusion by Deputy Prime Minister Tran Hong Ha at a meeting on the Decree detailing the implementation of Resolution 171/2024/QH15 of the National Assembly on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights.
Accordingly, on February 18, 2025 at the Government headquarters, Deputy Prime Minister Tran Hong Ha chaired a meeting to listen to a report on the Decree detailing the guidance on Resolution 171/2024/QH15 dated November 30, 2024 of the National Assembly on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights.
At the meeting, Deputy Prime Minister Tran Hong Ha highly appreciated the efforts of the Ministry of Natural Resources and Environment (MONRE) in drafting the Decree in the past time and perfecting the comments of relevant ministries, branches and localities at the meeting to complete the draft Decree right from the drafting stage, ensuring the draft is highly feasible.
Resolution 171/2024/QH15 on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights has very clear regulations on space, scale, subjects, and conditions for the pilot.

Accordingly, the Decree needs to be specifically regulated to ensure feasibility and implementation in practice. The Ministry of Natural Resources and Environment is requested to continue synthesizing and studying the contributions of relevant ministries, branches, localities, organizations and individuals, focusing on completing the draft Decree in the direction of:
Clearly stipulate the specific methods, order, procedures, records, responsibilities, and authority of each agency in each case: Real estate business organizations receiving land use rights; cases of real estate business organizations having land use rights; real estate business organizations established by organizations using land to implement commercial housing projects on the area of production and business establishments that must be relocated due to environmental pollution, establishments that must be relocated according to construction planning, urban planning, etc. to ensure implementation in practice.
Supplementing clear regulations on principles, criteria, and priority order for selecting projects in the List of land plots for pilot project construction projects, ensuring transparency ( relocation of polluted facilities, urban beautification, areas with detailed planning, etc.), preventing the situation of asking for and giving.
Study and supplement transitional regulations, regulate the responsibilities of project investors in arranging social housing according to the law on housing, review and unify the concepts in the draft Decree.
The Ministry of Natural Resources and Environment continues to complete the draft Decree dossier according to the comments of relevant ministries, branches, organizations and individuals, send it to the Ministry of Justice for appraisal in accordance with relevant legal regulations, and submit it to the Government for consideration before March 10, 2025.
