Regarding this content, the Ministry of Construction would like to respond as follows:
Article 76 of the 2023 Housing Law specifically stipulates the subjects entitled to housing support policies.
Clause 1, Article 78 of the 2023 Housing Law stipulates that subjects specified in Clauses 1, 4, 5, 6, 7, 8, 9 and 10, Article 76 who meet the housing conditions and income conditions specified in this Clause are allowed to buy or rent social housing.
Point d, Clause 1, Article 79 of the 2023 Housing Law stipulates the principles for implementing social housing support policies as follows: "Ensure the right subjects and conditions according to the provisions of this Law".
At point d, point d and point g, Clause 1, Article 38 of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing stipulates:
After collecting all the registration documents of those in need, investors of social housing construction investment projects are responsible for reviewing each registration file, comparing it with the regulations on subjects and conditions according to the provisions of Articles 76 and 78 of the Housing Law, document forms according to the instructions of the Minister of Construction, the Minister of National Defense and the Minister of Public Security to make a List of subjects eligible to buy social housing under the project invested by themselves...
The investor of a social housing construction investment project is responsible for submitting a list of subjects expected to be eligible to buy social housing in order of priority according to the principle prescribed in Clause 2 of this Article to the Department of Construction of the locality where the project is located to conduct an inspection to determine the correct subjects eligible to buy social housing and excluding the fact that the registered buyer of social housing in this project has bought or rented social housing, and has been supported by the State in all forms in the province or centrally run city where the social housing project is located.
The competent authority issuing certificates of land use rights and ownership of assets attached to land in the locality where the social housing construction investment project is located is responsible for coordinating with the local Department of Construction where the project is located to check information according to its authority and is responsible for the verification results.
At the time of receiving the documents and checking the subjects, the investor was not required to have the sales price appraisal results of the competent authority.
Investors are only allowed to sign a social housing sale and purchase contract with customers when they are eligible for sale according to the provisions of the law on housing and the selling price has been appraised and approved by the competent authority according to regulations.
After signing a social housing sale and purchase contract, the project investor is responsible for making a complete list of subjects (including members of the household) who have purchased social housing and sending it to the local Department of Construction where the project is located for public announcement within 30 days from the date of receipt of this list and storing it for management and inspection ( post-inspection).
The Department of Construction is responsible for updating the list of subjects eligible to buy social housing on the Department of Construction's electronic information page according to the provisions of Article 44 of this Decree and sending this list (hard drive and electronic file) to the Ministry of Construction for monitoring.
At the same time, the project investor is responsible for publicly announcing this list at the investor's office and at the Real Estate Exchange or the investor's social housing information page (if any)".
Thus, the law on housing only stipulates housing conditions and income conditions for subjects entitled to housing support policies ( Conditions for the petitioner) when reviewing the application for social housing purchase.
At the time of submitting the application, customers must meet the conditions according to the provisions of the law on housing to be eligible to buy social housing.
