According to Notice No. 81/TB-UBND of Hai Phong City People's Committee, based on current regulations, Hai Phong City People's Committee has issued a notice on the land recovery of Mai Thanh An Company Limited in An Dong Ward, An Duong District due to violations of land law
Previously, since 2012, the People's Committee of Hai Phong City leased 10,302.7 m2 of land in An Dong Commune, An Duong District (now An Dong Ward, An Duong District) to Mai Thanh An Company Limited to implement the new An Dong Market Investment, Construction, Management, Trading and Exploitation Project. after 10 years, the project has not been implemented. By 2022, the People's Committee of Hai Phong City has decided to extend the land use period for 24 months for Mai Thanh An Company Limited to implement the investment project to build, manage, operate and exploit the new An Dong market in An Dong commune, An Duong district.
However, after 2 years of extension, the unit has not been able to implement the project, so the People's Committee of Hai Phong City has issued a notice to reclaim 10,302.7 m2 of land in An Dong ward, An Duong district, managed and used by Mai Thanh An Company Limited, which is subject to recovery due to violation of land laws as prescribed in Clause 8, Article 81 of the 2024 Land Law - due to slow implementation of the project according to regulations.
According to the announcement of the Hai Phong City People's Committee, the location and boundary of the land plot are determined according to the main continental coordinates established by the Center for Engineering - Data, Natural Resources and Environment Information under the Department of Natural Resources and Environment. Mai Thanh An Company Limited is not compensated for land, assets attached to the land and remaining investment costs in the land.
Notice requiring Mai Thanh An Company Limited to urgently relocate assets on the land in An Dong ward, An Duong district within 45 days from the date of receipt of the Notice; beyond the above deadline, the assets that have not been relocated from the land are determined to no longer need to be used, the City People's Committee will continue to carry out the land recovery procedures due to violations of land law according to regulations and will not be responsible for assets that have not been relocated from the above land.
In case Mai Thanh An Company Limited does not comply, the An Duong District People's Committee will be assigned to enforce the decision to reclaim the land according to regulations.
