If the house and land are the common property of both husband and wife, the red book must have the names of both husband and wife, unless there is a separate agreement.

When is the red book registered with both husband and wife?

According to the provisions of Clause 4, Article 135 of the Land Law No. 31/2024/QH15, the red book is the common property of a married couple, so both the full name of the husband and wife must be recorded in the red book, except in cases where the two people have agreed to record the name of the husband or wife as the representative.

Conditions for adding wife/husband's name to the red book

In case the red book already has the name of the husband/wife, to add the name of the other person to the book, the following conditions must be met:

- The current red book only has the name of the wife/husband.

- Land use rights, property ownership rights... are common property of husband and wife.

For example, created by the husband and wife, purchased from income from labor, production, business... during the marriage.

Because husband and wife inherit or receive a gift together.

Land use rights and home ownership rights that husband and wife agree are common property.

- Husband/wife wants to add the other person's name to the red book.

Application for adding wife/husband's name to the red book

The red book exchange file includes: application for red book exchange according to form No. 10/DK; original red book; mortgage contract for land use rights (if the land is in the bank).

Submit the application to add the name of the wife/husband to the red book at the Land Registration Office in the locality where this agency has been established. Or the People's Committee (PC) at the district level if the locality has not yet established a Land Registration Office.

Procedures for adding the name of the wife/husband on the certificate

Step 1: Submit application

Step 2: Receive and process documents.

If the application is not complete or valid, we will provide instructions within a maximum of 3 days; if complete, we will return the application receipt.

Step 3: Check and prepare documents to submit to the red book issuing authority; update and correct land records and land database.

Step 4: Return the red book, within 3 working days from the date of result.
