HCMC removes financial obstacles to issue pink books to thousands of apartments

Many apartment, townhouse and villa projects in Ho Chi Minh City are being resolved with legal difficulties and obstacles so that the authorities will soon issue pink books to the people.

Many projects are cleared of obstacles

The 1645 Working Group chaired by Director of the Ho Chi Minh City Department of Natural Resources and Environment Nguyen Toan Thang worked with many investors to remove obstacles and speed up the issuance of pink books to home buyers. For example, the CC2 apartment project (Palm Heights) in Binh Trung ward with 816 apartments, including three basement towers, a community house has been completed, and a nursery has not yet been built.

The project is invested by Nam Rach Chiec Company Limited, with an area of 30.2 hectares, the City People's Committee has allocated land to serve resettlement in the new urban area of Thu Thiem using budget capital (clean land), but not through auction of land use rights or project bidding.

After that, the City People's Committee adjusted the planning, allowing the conversion of land use purpose from resettlement land to residential, commercial and service business land without auction, which is a violation of regulations. The city's functional departments and branches have not fully determined the financial obligations for a part of the land area, of which the project of Nam Rach Chiec Company Limited is 40,850m2.

In addition, the City People's Committee did not calculate land use fees at the time of land allocation or land lease. That is the calculation of land use fees at the time of 2008, while the City People's Committee issued Decision No. 3215 2012 to Nam Rach Chiec Company Limited for lease, applying inappropriate valuation methods.

Regarding this case, Director of the Department of Agriculture and Rural Development of Ho Chi Minh City Nguyen Toan Thang has issued a conclusion, agreeing to issue a certificate to the home buyer, and the ownership of the company will be considered after the related obligations are resolved. As for the part owned by the investor, it will continue to be handled according to the contents of the conclusion of the Government Inspectorate and the issuance of pink books will be resolved later.

Another project is the apartment block 6, 7, 8 complex high-rise areas in Tan Phu ward, formerly District 7 (now Tan My ward), invested by Riviera Point Company Limited. The investor's representative said that due to the planning adjustment, in 2020, the Department of Natural Resources and Environment of Ho Chi Minh City (old) requested to re-determine financial obligations, then the Economic Department replied that no financial obligations arose.

Regarding infrastructure, the unit has handed over land to build a school, route No. 1 with a length of 500m has been completed and connected; of the 518 apartments, 128 are for sale to foreigners. However, regarding financial obligations, a representative of the Land Management Department said that financial obligations must be re-determined according to the inspection conclusion.

Mr. Nguyen Toan Thang requested the Economic Department to work with the investor soon to clarify financial obligations and requested the investor to commit to completing the infrastructure, building schools according to the plan... before considering granting certificates.

The latest report from the Ho Chi Minh City Department of Natural Resources and Environment said that as of August, the city had reviewed 108,170 apartments and houses in 176 projects and the authorities had removed obstacles to granting books to more than 87,500 apartments. Currently, Ho Chi Minh City still has about 12% of apartments with unresolved problems.

Removing land valuation bottles for projects

The Ho Chi Minh City Department of Natural Resources and Environment also said that there are currently 84 records of land allocation and land use conversion according to the 2003 Land Law that have not yet been assessed. Each related dossier has an average of about 1,000 apartments, or more than 84,000 apartments that have not been granted certificates of land use rights and house ownership rights (pink books).

The main reason for the problem is that in the period 2007-2010, data collection as a valuation basis was almost impossible. In areas such as Binh Chanh, Hoc Mon, Thu Duc (old), there are no similar apartment projects for comparison. To handle this, Ho Chi Minh City has repeatedly proposed to the Central Government to allow the application of a calculation method based on the land price list multiplied by the adjustment coefficient, but so far it has not been approved. Recently, the City People's Committee has reported to the Prime Minister, the Ministry of Agriculture and Environment, and the Ministry of Finance to find solutions.

If these documents are resolved, the city will have an additional 84,000 apartments granted certificates.
