Pursuant to Part 2 of the Administrative Procedures issued with Decision 3380/QD-BNNMT in 2025, the procedures for implementing the conversion of land allocation and land lease forms are as follows:
Step 1: The candidate submits the application to the Public Administration Service Center.
When submitting the application, the dossier submitter is selected to submit a copy of the document and present the original to the dossier receiving officer for inspection...
In case of submitting the application online, the application must be digitized from the original or a certified and certified copy of the document.
In case the Public Administration Service Center receives the dossier, the dossier shall be transferred to the provincial specialized agency on agriculture and environment.
Step 2: The provincial specialized agency for agriculture and environment shall:
- Assign the Land Registration Office to provide information about the land database, make an extract of a cadastral map of a land plot in case the dossier is complete and valid.
- instruct the dossier submitter to supplement the cadastral survey of the land plot for the land plot in a place without a cadastral map according to regulations or re-make the dossier or supplement the dossier and submit it to the provincial-level specialized agency on agriculture and environment in cases where the dossier is incomplete or invalid.
- Review and check records; on-site inspection.
- Preside over and coordinate with relevant agencies to determine cases of exemption from land use fees and land rents (if any).
- Complete the dossier to submit to the Chairman of the Provincial People's Committee.
- Submit to the Chairman of the Provincial People's Committee to issue a decision.
Step 3: The Chairman of the Provincial People's Committee shall consider issuing a decision to change the form of land allocation and land lease.
Step 4: (applicable to cases where land users must pay land use fees and land rents):
a, In case the land user must pay land use fees and land rents calculated according to the land price list:
- The provincial specialized agency on agriculture and environment transfers the Information Transfer Form to determine financial obligations on land according to Form No. 19 issued with Decree 151/2025/ND-CP amended and supplemented in Decree 226/2025/ND-CP to the tax authority...
b, In case the land user must pay land use fees and land rents calculated at specific land prices:
- Provincial specialized agencies on agriculture and environment:
+ Organize the determination of specific land prices.
+ Submit to the Chairman of the Provincial People's Committee to issue a decision approving specific land prices with the responsibility of the tax authority in guiding land users to pay land use fees and land rents.
- The Chairman of the Provincial People's Committee shall consider and issue a decision approving specific land prices.
- The provincial specialized agency on agriculture and environment transfers the Information Transfer Form to determine financial obligations on land according to Form No. 19 issued with Decree 151/2025/ND-CP amended and supplemented in Decree 226/2025/ND-CP to the tax authority.
- Tax authority:
+ Determine land use fees and land rents payable according to regulations; determine land rents payable for a number of years in cases of being exempted from land rent for a number of years after the period of being exempted from land rent for the period of basic construction.
+ Issued a notice of payment of land use fees and land rents to land users.
- Land users pay land use fees and land rents according to the provisions of law on land use fees and land rents.
- The tax authority confirms the completion of payment of land use fees and land rents and sends a notice of results to the provincial specialized agricultural and environmental agency.
Step 5: Provincial specialized agencies on agriculture and environment:
- Signing or transferring to competent authorities to sign the Certificate or confirm changes on the Certificate according to the provisions of land law;
- Transfer the dossier to the Land Registration Office;
- The handover of land on site is carried out according to Form No. 24 issued with Decree 151/2025/ND-CP and the Certificate is granted to the land user.
Step 6: Land registration office:
- Issuing a new Certificate or confirming changes on the issued Certificate in cases under the authority assigned according to the provisions of the land law.
- Update and edit the land database, cadastral records and transfer the Certificate to the dossier receiving agency for payment.
