On November 14, continuing the program of the 10th Session, the National Assembly discussed in the hall the Construction Law (amended).
Discussing in the hall, National Assembly delegate Nguyen Thi Viet Nga (Hai Phong delegation) said that the draft law stipulates the exemption of construction permits for some types of works in the direction of reducing "pre-inspection" and increasing "posthumous inspection" in the management of construction works.
This is a content in line with the goal of reform, cutting administrative procedures, reducing time and costs for implementing administrative procedures for people and businesses - delegate Nguyen Thi Viet Nga emphasized.
This delegate said that for many years, illegal construction, encroachment on sidewalks and public land, construction beyond floors, changes in functions... have occurred in many places. Many works were not discovered early, only when the works were almost completed or completed were they discovered and handled.
This situation is partly due to the "very thin" team of construction experts at the commune level, not having enough forces to supervise and promptly detect violations; in some localities, there is a shortage of staff with deep expertise in construction.
Therefore, in parallel with cutting the "pre-inspection" stage and exempting construction permits for some construction works, it is necessary to supplement mechanisms to strengthen "post-inspection" to detect and handle violations promptly;
Clearly define the responsibility of the People's Committees at the commune level in inspecting, detecting and handling violations of construction regulations right from the first stage.
The delegate proposed to add sanctions to handle the responsibility of the head if violations in construction works are not detected or promptly handled; study the arrangement of forces to support construction management at the grassroots level... to truly "posthumously" and effectively.

Regarding this content, delegate Pham Van Hoa (Dong Thap delegation) said that in reality, there have been many stories related to whether or not to issue construction permits, shifting from "pre-inspection" to "post-inspection".
This delegate gave an example of the case of mistakenly building a house on neighboring land in Hai Phong or recently in Ho Chi Minh City.
Thus, the responsibility of the government agency is very important in post-inspection. We must avoid the case of the project being completed before post-inspection, then having a dispute, which will cost people's money.
"Like the case in Hai Phong, listening to an intermediary pointing out land and then mistakenly building a house on someone else's land. If the land officer went down from the licensing location and pre-inspects to the location to the construction owner, there would be no houselapse" - the delegate of Dong Thap emphasized.
Therefore, in the process of building and shifting from pre-inspection to post-inspection, it is necessary to pay attention to the responsibility of local authorities. When people report, they must come to inspect, urge, and remind to avoid causing bad consequences for people's works and state works.
Delegate Pham Van Hoa gave an example of asking to build a 10-storey apartment building but building up to 11, 12 floors, after making a record, now let it exist or not let it exist.
"If we had pre-inspected it from the beginning, people would have asked for permission to build 10 floors, we would only allow 10 floors to be built to prevent it in time. If we wait until people build 12, 13 floors, then we will not make a record, it will be expensive" - the Hoa delegate said.
