Citizens send questions to the Ministry of Agriculture and Environment asking about the following two situations:
(1) I have 2 adjacent plots of land, including residential land and other land in the same plot of land. However, the term of use of the "other land" part of each plot is different. When carrying out the land consolidation procedure, Article 220 of the Land Law requires adjusting the land use term to unify within a certain period. However, according to Decree 151/2025/ND-CP, there is currently no application for adjusting land use term, except for Form No. 12 - Application for adjusting land use term applied to investment projects. So in the case of a household or individual like me, which application form should be used or in what order should it be implemented?
(2) My plot of land has been granted a Certificate, including residential land and other land in the same plot. Currently, the term of use of the "other land" has expired. So do I have to carry out procedures to extend or re-confirm the term of use of this land before transferring the rights? At the same time, according to Decree 151/2025/ND-CP, there is currently no form of application for re-confirmation of land use term. In this case, how should I do it?
Responding to these contents, the Ministry of Agriculture and Environment said:
- Proposal 1: After 1 year of assessing the implementation of the 2024 Land Law, the Ministry of Agriculture and Environment has noted the above problems and proposed that competent authorities amend and supplement regulations on land consolidation in the direction of: consolidating non- compulsory land plots with the same land use purpose, same land use form, same land use term in the draft Resolution of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law.
Currently, the draft Resolution has been submitted by the Government to the National Assembly for consideration and approval at the 10th session. The Ministry of Agriculture and Environment provides additional information for citizens to know.
- Proposal No. 2: According to the provisions of the law on land, in case of land use with a term, when the term expires, the land user must carry out extension procedures. The application for an extension of land use is form No. 04, Appendix 2 issued with Decree No. 151/2025/ND-CP
