There are projects that have not had a pink book for 20 years
Speaking to Lao Dong Newspaper reporter, Mr. Le Hoang Chau - Chairman of the Ho Chi Minh City Real Estate Association (HoREA) said that he had just sent a petition to the City People's Committee and the Department of Agriculture and Environment of Ho Chi Minh City to propose removing obstacles related to the 10% land fund for resettlement housing, causing many apartments not to be granted pink books.
According to the petition, HoREA said that the city currently has about 17 commercial housing projects facing difficulties related to the regulation of reselling housing funds for resettlement to the city (Directive 07), leading to many home buyers not being granted pink books.
The Association cited the case of Duong Hong House Construction and Trading Joint Stock Company, the investor of the 9B4 - 9B8 Housing Project in Binh Hung Commune, Binh Chanh District.
In 2004, Duong Hong Company was allocated land by the Ho Chi Minh City People's Committee to implement a housing project. According to the plan, the project has a total of 254 apartments, of which 25 apartments belong to a 10% land fund.
After Official Letter 7623, the investor deployed infrastructure and sold all products. To date, the Company has issued pink books to 229 apartments, but the remaining 25 apartments belonging to the 10% land fund are still suspended. This incident has lasted for 20 years, and until now, residents have not been granted pink books, greatly affecting the rights of home buyers.
A similar situation occurred with the Riva Park project (District 4) invested by Vietcomreal. Although District 4 confirmed that there is no need to buy back 150 apartments subject to resettlement and the investor has sold them to the people, these apartments have not yet been granted a certificate due to the issue of Directive 7.
Hundreds of apartments in projects such as EHome3 (Binh Tan District) or Phuong Viet (District 8) are also in a similar situation.
People suffer
The reason for this situation comes from the time in 2003, the Ho Chi Minh City People's Committee issued Directive No. 07/2003/CT-UB, which requires housing project investors to reserve 10% of their land fund for housing construction or 20% of their housing fund for sale according to the principle of capital conservation (with audits) to the State to include in the housing fund and land for resettlement programs for key projects of the City.
After that, the Ho Chi Minh City People's Committee issued a directive on investing in the construction of 30,000 apartments for resettlement in Ho Chi Minh City, encouraging businesses to build apartments for resettlement, after completing the construction, the housing fund will be resold to the city according to the construction price plus standard profit.
Based on these directives, most commercial housing projects are allocated land in the period from 2003-2005, the Ho Chi Minh City People's Committee requires investors to reserve 10% of residential land fund or 20% of housing fund or resell apartments in the project to the City for resettlement services.
However, during the project implementation, it is a reality that in some districts, there is no need to buy back resettlement housing funds or residential land for resettlement.
Faced with this situation, the Ho Chi Minh City People's Committee has also approved not to buy back resettlement houses and proposed to review and determine financial obligations arising (if any) from the city not to buy back these houses and land.
However, up to now, the determination of financial obligations for projects with resettlement housing funds has not been implemented, causing people who buy houses to not be granted pink books.
Mr. Le Hoang Chau - Chairman of HoREA said that this problem is completely under the handling authority of the Ho Chi Minh City People's Committee and needs to be handled quickly to protect the rights of home buyers.
For example, in the case of Residential Area 9B4 - 9B8, this project has full legal documents and has fulfilled financial obligations to the State and has been granted pink books for 90% of apartments.
Therefore, it is necessary to issue pink books to the remaining 25 customers, completely resolve the legitimate rights of home buyers, to avoid prolonged complaints.
The Ho Chi Minh City People's Committee considers directing the Department of Agriculture and Environment to guide the resolution of difficulties for projects facing similar difficulties, speeding up the implementation of procedures for granting pink books to residents.
