Some enterprises have evaded payment, paid late, or paid incorrectly or insufficiently according to the salary fund and the number of employees required to pay the union fund according to regulations... affecting the operating budget of trade unions at all levels in performing well the function of representing and protecting the legitimate and legal rights and interests of employees.
According to Mr. Cuong, the failure of enterprises to pay union fees results in grassroots unions having no funding to organize activities, especially taking care of union members and workers on holidays and Tet as well as regular care at the grassroots union level, affecting the rights and interests of union members and workers, directly affecting the movement of workers, civil servants, laborers and the activities of the Hoa Binh Provincial Trade Union. At the same time, they violate the law and are subject to administrative sanctions according to the provisions of Article 38 of Decree No. 12/2022/ND-CP dated January 17, 2022 of the Government on violations of regulations on paying union fees and may be prosecuted for criminal liability according to Clause 1, Article 31 of the Law on Vietnam Trade Unions.
