Mr. Nguyen Van Dinh (character's name has been changed) wondered: In the case of a long-term labor contract in the People's Public Security, receiving salary from the state budget and having to pay compulsory social insurance, will it be counted as service time in the People's Public Security? And how is the method of calculating service time in the People's Public Security specifically regulated?
Regarding Mr. Dinh's question, the Ministry of Public Security responded on the Electronic Information Portal.
Pursuant to Article 9 of the Law on the People's Public Security, the subjects of service in the People's Public Security (CAND) include: CAND officers (serving under professional regimes); non-commissioned officers, CAND soldiers (serving under professional regimes or service regimes) and police workers (serving under recruitment regimes).
Thus, the People's Public Security Law does not stipulate the service regime in the People's Public Security for contract workers.
Pursuant to Article 2 of Circular No. 54/2014/TT-BCA dated October 30, 2014 of the Minister of Public Security regulating the seniority allowance regime in the People's Public Security, it is stipulated that:
This Circular applies to officers and non-commissioned officers; officers and non-commissioned officers in technical expertise in the People's Public Security;
This Circular does not apply to non-commissioned officers and soldiers serving for a limited period of time; workers, civil servants; and those working under labor contracts in the People's Public Security.
"Therefore, the period of being a long-term labor contract in the People's Public Security, receiving salary from the state budget and having paid compulsory social insurance is not counted for seniority in the People's Public Security" - the Ministry of Public Security said.
For contract workers in the People's Public Security (including long-term contract workers) is determined to be working time under the form of labor contracts in the People's Public Security and enjoy the regimes and policies prescribed for contract workers according to the provisions of the Labor Code and Circular No. 22/2022/TT-BCA dated May 10, 2022 of the Minister of Public Security regulating contract workers in the People's Public Security.
