Clause 3, Article 4 of the Law on Cadres and Civil Servants 2008 stipulates the requirements for commune-level cadres as follows:
Cadres of communes, wards and towns (hereinafter referred to as commune level) are Vietnamese citizens, elected to hold positions for terms in the Standing Committee of the People's Council, People's Committee, Secretary, Deputy Secretary of the Party Committee, head of socio-political organizations; commune-level civil servants are Vietnamese citizens recruited to hold a professional and technical position under the People's Committee at the commune level, in the payroll and receiving salaries from the state budget.
Thus, commune, ward and town cadres (collectively referred to as commune-level cadres) are Vietnamese citizens and are elected to hold positions for terms in the Standing Committee of the People's Council, People's Committee, Secretary, Deputy Secretary of the Party Committee, head of the socio-political organization; are on the payroll and receive salaries from the state budget.
In Decree No. 33/2023/ND-CP, Clause 1, Article 5 stipulates the positions of commune-level cadres as follows:
1. Commune-level cadres specified in Clause 1, Article 2 of this Decree hold the following positions:
a) Party Committee Secretary and Deputy Secretary;
b) Chairman and Vice Chairman of the People's Council;
c) Chairman and Vice Chairman of the People's Committee;
d) Chairman of the Vietnam Fatherland Front Committee;
d) Secretary of the Ho Chi Minh Communist Youth Union;
e) President of the Vietnam Women's Union;
g) Chairman of the Vietnam Farmers' Union (applicable to communes, wards and towns with agricultural, forestry, fishery, fishery activities and with the Vietnam Farmers' Union);
h) Chairman of the Vietnam Veterans Association.
