Point a, Clause 1, Article 20 of the 2019 Law on Militia and Self-Defense Forces stipulates as follows:
Military command committees at commune and village levels
1. The Commune-level Military Command is the standing agency for national defense work at the commune level. The members of the Commune-level Military Command include:
a) Commanders who are members of the People's Committee at the commune level, reserve officers; in a state of national defense emergency or war situation are called up to serve in the army according to the provisions of the Law on Officers of the Vietnam People's Army and continue to hold the position of Commander of the Commune-level Military Command;
b) Political Commissar appointed by the Secretary of the Commune-level Party Committee;

Thus, the Commander of the Commune-level Military Command is a member of the Commune-level People's Committee, a reserve officer. In a state of national defense emergency and during war, he was called up for military service according to the provisions of the Law on Officers of the Vietnam People's Army 1999 and continued to hold the position of Commander of the Commune-level Military Command.
Clause 3, Article 7 of the Law on Officers of the Vietnam People's Army 1999 stipulates that the reserve officer rank is a rank consisting of officers of the reserve force who are registered, managed, and trained to be ready for mobilization to serve in the army.
