On the afternoon of October 8, at the hall of the Ninh Thuan Provincial Federation of Labor, the Provincial National Assembly Delegation coordinated with the Provincial Federation of Labor to organize a conference to meet voters, union members, and workers in 2024.
Informing voters, a representative of the National Assembly Delegation of Ninh Thuan province said that the 8th session of the 15th National Assembly, which is about to open, is expected to pass many important Law projects directly related to the legitimate rights and interests of union members and workers.
To listen to the voices of cadres, union members, and workers, today's thematic voter contact is an opportunity for the National Assembly Delegation of Ninh Thuan province to better understand the thoughts, aspirations, comments, and recommendations of voters, so that the delegates can inform the drafting committee at the 8th Session.
At the meeting with voters, Ms. Dang Thi Thuy Van - a worker at Thai An Garment Company Ltd. expressed her opinion: In the past, there were still a number of employees who did not enjoy unemployment insurance benefits, due to ineffective business operations leading to dissolution, bankruptcy... Therefore, in the draft Law on Employment (amended), the National Assembly needs to have stronger sanctions.
Representative of the Trade Union of Saigon - Ninh Chu Tourism Joint Stock Company, Mr. Nguyen Van Quyen said that the provisions of the Law on Employment are that employees participating in unemployment insurance are only entitled to benefits when they are unemployed.
In fact, many workers have stable jobs and have paid unemployment insurance for a long time but have not received any benefits because they are not unemployed. Workers feel disadvantaged because they have paid but have not received any benefits.
"I propose that the National Assembly study and have regulations to support this group of people when they retire according to the principle of contribution - enjoyment" - Mr. Quyen said.
Sharing the same opinion, Mr. Ho Tan Ninh - Tien Thuan Garment Company Limited commented that Clause 2, Article 95 of the Draft Law on Employment stipulates that "The period of unemployment benefits is calculated based on the number of months of unemployment insurance contributions. For every 12 months of contributions up to 36 months, you will receive 03 months of unemployment benefits. After that, for every additional 12 months of contributions, you will receive 01 more month of unemployment benefits, but not exceeding 12 months".
Thus, employees who have paid unemployment insurance for more than 144 months will not receive any additional benefits. This will affect the psychology of employees, causing them to seek ways to quit their jobs and receive unemployment benefits when they reach the threshold.
Mr. Ninh proposed: "The National Assembly should consider increasing the unemployment benefit period according to the principle of "contributing and receiving", "contributing for as many years as receiving for as many months" to ensure the rights of workers when participating and limit the situation of taking advantage of policies".
Some voters who are union officials also pointed out that the process of inspecting and monitoring the situation of enterprises evading, delaying payment, and misappropriating social insurance and unemployment insurance contributions of employees is still quite large. Therefore, this amendment to the Law on Employment needs to develop "specific" regulations to pay unemployment benefits to employees who participate in unemployment insurance but enterprises evade, delay payment, and misappropriate employees' contributions.
According to Mr. Tran Van Dong - Chairman of the Ninh Thuan Provincial Federation of Labor, with 12 opinions and recommendations of union members and workers raised at the meeting with voters, of which, 6 opinions were recorded to contribute to the Draft Law on Employment (amended) and recommendations on attracting investment in industrial parks, providing information on social housing, unifying a set of textbooks for the education program... Union members and workers of Ninh Thuan expect the National Assembly to build a solid legal corridor for the activities of the Trade Union organization, protecting the legitimate and legal rights of workers.
