Agree with the revised Trade Union Law
Mr. Tran Van Dong - Chairman of the Ninh Thuan Provincial Federation of Labor said that through 12 rounds of comments and suggestions, the meeting with voters, employees and trade unions at all levels have trusted and fully conveyed their beliefs and wishes to the provincial National Assembly delegates. Hopefully, the laws passed by the National Assembly at the 8th session will be a solid legal corridor for the activities of the Trade Union organization, protecting the legitimate rights and interests of employees. Ninh Thuan currently has 40,198 employees working at agencies, units and enterprises with Trade Union organizations.
According to Mr. Dong, through understanding the feelings of workers, a number of union members are concerned and worried about the current situation of businesses facing difficulties, the rising prices of some goods, the slow payment of insurance at some businesses... which will directly affect the rights of workers.
After many rounds of collecting opinions on the draft Trade Union Law (amended), voters were very excited when the contents of regulations on payroll, recruitment, representation and protection of rights, time to perform trade union tasks, trade union funds, etc. were received, revised and completed by the Central Government, Ministries and branches and prepared to be submitted to the 8th session of the 15th National Assembly.
At the meeting with voters, there was a proposal to grant autonomy to the Vietnam General Confederation of Labor to issue standards, norms, spending regimes, decentralize collection, distribution, management and use of trade union finances in accordance with the requirements of the organization's tasks on the basis of applying regulations issued by the State. Voters highly agreed and hoped that the National Assembly Delegation of Ninh Thuan province would consider and support the Trade Union Law (amended) to be passed soon.
Many comments on the draft revised Law on Employment
At the meeting with voters on the afternoon of October 8, 6/12 comments on the draft revised Law on Employment were still inadequate.
Ms. Dang Thi Thuy Van (Thai An Garment Company Limited) stated that according to the Law on Employment, in the past, there were still a number of employees who did not enjoy unemployment insurance benefits due to ineffective business operations leading to dissolution, bankruptcy, or business owners intentionally fleeing... Therefore, the new regulations need to have stronger sanctions.
Also related to the revised Law on Employment, Mr. Nguyen Van Quyen - a member of the Trade Union of Saigon - Ninh Chu Tourism Joint Stock Company, said that the provisions of the Law on Employment are that employees participating in unemployment insurance are only entitled to benefits when they are unemployed.
In practice, many workers have stable jobs and have paid unemployment insurance for a long time but have not enjoyed unemployment insurance benefits because they have not been unemployed. Workers feel disadvantaged when they have paid but do not receive benefits. Therefore, Mr. Quyen proposed that the National Assembly study and have regulations to support this group of people when they retire according to the principle of contribution - benefit.
Some voters who are union officials also pointed out that the situation of enterprises evading, delaying payment, and misappropriating social insurance and unemployment insurance contributions from employees is still quite common. This causes obstacles in paying unemployment insurance benefits to unemployed employees and seriously affects the rights of employees. Therefore, this amendment to the Law on Employment needs to develop "specific" regulations to pay unemployment benefits to employees who participate in monthly unemployment insurance but whose enterprises evade, delay payment, or misappropriate unemployment insurance contributions...
