Pursuant to the provisions of Clause 5, Article 61 of the Law on Social Insurance 2024, it is stipulated as follows:
Application for maternity benefits

5. The application for resignation from work to enjoy maternity benefits or receive one-time allowances for male employees when the wife gives birth is a copy of the birth certificate or birth certificate or a copy of the child's birth certificate; in case the birth certificate does not show information about giving birth requiring surgery or giving birth under 32 weeks old, an original or a copy of the document of the medical examination and treatment facility showing information about giving birth requiring surgery or giving birth under 32 weeks old is required.
In case the child dies after giving birth without being granted a birth certificate, the file must be the original or a copy of the summary of the medical record or a discharge letter from the mother that can show information about the child's death.
6. The application for maternity benefits for the husband of a female employee who is a surrogate mother receiving a one-time allowance upon receiving a child must have a copy of the birth certificate or birth certificate or a copy of the child's birth certificate. In case the child dies after giving birth without being granted a birth certificate, the dossier must be a copy of the medical record summary or the original or a copy of the discharge paper of the surrogate mother showing information about the child's death or other documents from the medical examination and treatment facility showing information about the child who died after giving birth.
7. The application for resignation to enjoy maternity benefits or receive one-time allowances for the husband of a female employee who is a surrogate mother when the wife gives birth includes the following documents:
a) copy of birth certificate or birth certificate or copy of birth certificate; in case the birth certificate does not show information about giving birth with surgery or giving birth under 32 weeks old, an original or copy of the document of the medical examination and treatment facility showing information about giving birth with surgery or giving birth under 32 weeks old is required;
b) copy of the agreement on surrogacy for humanitarian purposes as prescribed in Article 96 of the Law on Marriage and Family.

In case the birth certificate does not show information about giving birth under surgery or giving birth under 32 weeks old, the original or a copy of the document of the medical examination and treatment facility showing information about giving birth under surgery or giving birth under 32 weeks old.
In case the child dies after giving birth without being granted a birth certificate, the file must be the original or a copy of the summary of the medical record or a discharge letter from the mother that can show information about the child's death.
