Within the framework of the recently organized Online Dialogue and Exchange program, policy communication, and dissemination of new points on labor law, social insurance and trade union activities in 2025, workers asked: I was born in 1969, have paid compulsory social insurance for 14 years and 11 months. May I ask, in January 2026, I am old enough to receive a pension, but if I want to receive one-time insurance, will I be able to receive it immediately or do I have to wait a year without participating in social insurance? While waiting to receive one-time social insurance, will I be entitled to unemployment insurance?
Ms. Duong Thi Minh Chau - Head of the Department of Propaganda and Support for Participants, Hanoi Social Insurance said that according to the provisions of the Social Insurance Law 2024, those who have paid social insurance for 15 years are eligible for pension. In the case of employees who have worked for enough time and paid enough social insurance for enough years to receive a pension, they will not be covered by one-time social insurance but will only receive a pension. Only special cases such as: People with serious illnesses, people with 81% health problems who need will be resolved at one time.
At the same time, according to the 2025 Employment Law, effective from January 1, 2026, if employees are eligible for retirement, they will not receive unemployment benefits. Therefore, workers are not entitled to one-time social insurance and are not entitled to unemployment benefits.
