Clause 4, Article 4 of Decree 73/2024/ND-CP stipulates as follows:
The annual bonus fund prescribed in this Article is outside the reward fund prescribed by the Law on Emulation and Reward, and is determined by 10% of the total salary fund (excluding allowances) according to the position, title, rank, level and military rank of the subjects in the salary list of the agency or unit.
By January 31 of the following year, if the agency or unit has not used up the year's bonus fund, it cannot transfer the source to the following year's bonus fund.
Meanwhile, Article 11 of the Law on Emulation and Commendation (effective from January 1, 2024) stipulates the Emulation and Commendation Fund as follows:
1. The emulation and reward fund is formed on the basis of the state budget, from the emulation and reward funds of enterprises, other economic organizations, contributions from domestic individuals and organizations, foreign individuals and organizations and other sources of revenue according to the provisions of law.
2. The emulation and reward fund is used to pay for organizing and implementing emulation and reward work; pay for emulation titles and forms of reward for achievements in building and defending the Fatherland; pay for printing, making reward objects or souvenirs for individuals, groups and households.
3. Ministries, departments, branches, localities, agencies, organizations and units shall establish emulation and reward funds to spend on organizing emulation movements and implementing policies and regimes on rewards in accordance with the provisions of law.
4. The person who decides on the reward is responsible for paying the reward from the emulation and reward fund managed by his/her level; in case the President, the Government or the Prime Minister decides on the reward, the agency that proposed the reward as prescribed in Clauses 2, 3 and 4, Article 83 of this Law is responsible for paying the reward from the emulation and reward fund managed by his/her level.
5. The Government shall detail the establishment, management and use of emulation and reward funds.
