Khanh Hoa Provincial Inspectorate has issued inspection conclusions on compliance with labor laws at 5 enterprises in the area.
The inspection results show that many enterprises have not fully complied with the provisions of the 2019 Labor Code. From signing contracts, arranging medical staff, to building regulations and equipping protective equipment for workers.
At Tran Vien Dong Company Limited (owner of Tran Vien Dong Hotel), the inspection agency discovered that the enterprise had signed labor contracts of the wrong type as prescribed in Article 20 of the 2019 Labor Code for 8 employees.
The company has not arranged medical staff at the enterprise or signed a contract with a medical facility with sufficient capacity to provide health care services for employees.
The list of personal protective equipment has not been fully updated in terms of quantity and types according to reality.
Tran Vien Dong Company Limited has developed and registered labor regulations, but based on the 2012 Labor Code - the document that has expired since December 31, 2020 - to issue internal regulations, which is not in accordance with current legal regulations.
During the inspection, Khanh Hoa Provincial Inspectorate also recorded tourism and hydropower enterprises violating probationary contracts and labor safety.
Specifically, at Khanh Tam Tourism Joint Stock Company, the enterprise signed a 30-31-day probationary contract for unskilled workers, which is not in accordance with the provisions of Clause 4, Article 25, Labor Code 2019.
Similarly, the company also signed a 61-62 day probationary contract for employees with intermediate qualifications - exceeding the maximum allowed period according to Clause 3, Article 25 of the law.
The Provincial Inspectorate also discovered that the content of the labor contract did not clearly show the work to be done, and at the same time lacked detailed information about the type and quantity of protective equipment provided to employees according to Article 21 of the 2019 Labor Code.
At Tan My Hydropower Joint Stock Company, the labor contract did not fully comply with the content according to Article 21, the enterprise has not yet arranged medical staff or signed a contract with a qualified medical examination and treatment facility, and has not posted safety regulations, machinery and equipment operation procedures in accordance with the provisions of the Law on Labor Safety and Hygiene.
Similarly, Ha Song Pha Hydropower Joint Stock Company has not fully demonstrated the content of the labor contract, especially regarding the equipment of personal protective equipment.
This enterprise still based on the 2012 Labor Code to develop labor regulations, violating current regulations.
Based on the inspection results, the Khanh Hoa Provincial Inspectorate has recommended that the Chairman of the Provincial People's Committee direct the Department of Home Affairs, People's Committees of communes, wards, special zones and relevant agencies to strengthen inspection of the implementation of labor laws and social insurance policies.
At the same time, care for improving working conditions, preventing and combating accidents and occupational diseases for workers in accordance with the provisions of law.
