If they go to the Central route, they will receive 40%. If the documents are not presented, they can pay directly to the social insurance agency (SI) to receive 15%.
According to the amended Law on Health Insurance (HI) 2024 and Circular 01/2025/TT-BYT, employees are still entitled to sick leave if they do not go to the correct place for examination, as long as they meet the conditions for accommodation (if changing the place of residence) or emergency situations.
In addition, workers wonder if they quit their jobs to receive sick leave for 14 working days or more in a month, they will not have to pay insurance, but in the following month, when they go to the doctor again, they will not be able to use the health insurance card due to sickness deduction. So what should workers do to protect their rights?
Ms. Duong Thi Minh Chau said that when employees are sick for 14 days or more in a month, they are still entitled to health insurance benefits and do not have to pay health insurance during that time, the old health insurance card will continue to be used until the end of the month, if they are still sick for a long time in the following month, they will be issued a new health insurance card, valid from the beginning of the following month.
Currently, according to regulations, in the case of employees discharged from the hospital in the morning (for example, 10am), the Social Insurance agency will pay the corresponding sick leave for half a day.
However, in reality, many cases after discharge still need more time to rest and recover their health. To enjoy full benefits, employees should ask their treating doctor to clearly state the time they need to take extra leave in the " note" of the Discharge papers.
If the hospital discharge certificate only states " seeing at 10am" without a note on the time of extra leave, the Social Insurance agency only has a basis to pay for half a day, and then the employee will suffer from benefits.
