Clause 3, Article 29 of the 2019 Labor Code stipulates:
Employees who switch to work other than under a labor contract will be paid according to the new job. If the salary of the new job is lower than the salary of the old job, the salary of the old job will be kept for 30 working days. The salary according to the new job must be at least 85% of the salary of the old job but not lower than the minimum wage.
Thus, during the first 30 days, employees will still keep the salary level according to the salary of the old job.
After 30 days, employees will receive wages according to the new job at least equal to 85% of the salary of the old job but not lower than the minimum wage.
Therefore, when the minimum wage is increased from January 1, 2026, the minimum wage when transferring jobs will also increase.
According to Decree 293/2025/ND-CP, from January 1, 2026, the minimum monthly salary in 4 regions is stipulated as follows:
Region I: increased by 350,000 VND, from 4,960,000 VND/month to 5,310,000 VND/month;
