The authority to decide on the transfer of public service units from November 1, 2025 is based on Decree 283/2025/ND-CP

According to the provisions of Article 8 of Decree 283/2025/ND-CP (supplementing Article 18a of Decree 120/2020/ND-CP), the authority to decide on the transfer of public service units from November 1, 2025 is as follows:

The Prime Minister decides on the transfer of public service units between ministries, ministerial-level agencies, and agencies under the Government (except for public service units under the organizational structure of ministries, ministerial-level agencies, and agencies under the Government); between ministries, ministerial-level agencies, and agencies under the Government with the Provincial People's Committees and between the Provincial People's Committees.

Ministers, heads of ministerial-level agencies, and heads of Government agencies decide on the transfer of public service units between organizations, units under ministries, ministerial-level agencies, and agencies under the Government.

The Provincial People's Committee decides on the transfer of public service units between other specialized agencies and administrative organizations under the Provincial People's Committee; between other specialized agencies and administrative organizations under the Provincial People's Committee with the Commune People's Committee and between the Commune People's Committees.
