The Ministry of Justice has just publicly disclosed documents appraising the draft Decree regulating the preservation and development of ethnic minority cultures.
Notably, in documents sent for appraisal, the Ministry of Culture, Sports and Tourism - the drafting agency said: Due to the lack of legal documents at the Decree level detailing regulations, the implementation of conservation projects is still phased and completely depends on funding from national target programs. This leads to a lack of unity in management mechanisms, support methods and efficiency evaluation criteria between localities.
The lack of legal and mandatory regulations has led many localities to develop a mentality of prioritizing the implementation of superficial, easy-to-disburse movement activities. Meanwhile, difficult but core tasks such as restoring original cultural values, folk knowledge or urgently preserving heritage sites that are seriously declining have not been given due to lack of identification criteria and mandatory implementation mechanisms.
The drafting agency recognizes that ethnic minority culture is an important resource for the economy, but the reality of "commercialization", "screening" is distorting the original cultural values at many community tourist destinations.
This poses an urgent requirement for a legal corridor that both protects the authenticity and integrity of traditional cultural values and creates conditions for businesses and communities to cooperate in developing sustainable livelihoods through self-management models.
Besides, there are limitations in mobilizing socialized resources. Conservation work currently still relies too much on the state budget. There is no clear mechanism, attractive enough to encourage organizations and businesses to invest in the field of ethnic minority culture. The public-private partnership (PPP) mechanism in culture is still new and lacks specific guidance, leading to the failure to promote the potential for voluntary contributions in cash, in-kind or working days from society.
From there, the completion of these practical bases affirms that the Decree is not only a state management requirement but also a practical solution to remove existing "bottlenecks", ensuring that culture truly becomes an endogenous strength for ethnic minority areas.
