Ministry of Education answers policy on considering support for study costs

The Ministry of Education and Training has answered citizens' questions about the consideration of support for study costs.

Mr. Ha Sy Gioi has a permanent residence in area 135 (Luong Thuong commune, Na Ri district, Bac Kan province) and is living in Bang Lung town, Cho Don district as a temporary resident. Mr. Gioi's children are studying in high school in the town and are not supported with study expenses according to Decree No. 81/2012/ND-CP because they have permanent residence in another district.

Mr. Gioi asked: "Are my children supported with study costs? The authorities determined that although my children are in the 135 area, they are not eligible for study cost support because they have permanent residence in another district. Is that correct? What document is the basis for determining that my children are not eligible for study cost support because they do not have permanent residence in the place where they study?"

The Ministry of Education and Training responded to this issue on the Government Electronic Information Portal as follows:

Clause 4, Article 18 of Decree No. 81/2021/ND-CP dated August 27, 2021 of the Government stipulates the mechanism for collecting and managing tuition fees for educational institutions in the national education system and policies on tuition exemption, reduction, and support for learning costs; service prices in the field of education and training stipulates the subjects eligible for support for learning costs:

"Kindergarten children and general education students, students at regular education facilities following the general education program in extremely disadvantaged villages/hamlets, communes in region III of ethnic minority and mountainous areas, and extremely disadvantaged communes in coastal and island areas according to regulations of competent authorities".

Mr. Ha Sy Gioi's family and children have permanent residence in Luong Thuong commune, Na Ri district, Bac Kan province, which is a commune in area III of ethnic minority and mountainous areas according to Decision No. 861/QD-TTg dated June 4, 2021 of the Prime Minister approving the list of communes in area III, area II, area I of ethnic minority and mountainous areas for the period 2021-2025.

However, Mr. Gioi's family and children are living (temporarily residing) in Bang Lung town, Cho Don district, Bac Kan province, not in a particularly difficult village/hamlet, a commune in region III of ethnic minority and mountainous areas, a particularly difficult commune in coastal and island areas according to regulations of competent authorities.

Therefore, Mr. Gioi's child is not eligible for support for study costs as prescribed in Clause 4, Article 18 of Decree No. 81/2021/ND-CP.
