On the afternoon of May 13, the Ministry of Education and Training provided information on the draft Decree regulating preferential allowances for civil servants and employees in public educational institutions.
This draft aims to overcome shortcomings in current regulations, ensure fair rights and demonstrate the commitment of the Party and State in the field of developing the teaching staff and educational managers.
Informing about the notable new points, the Ministry of Education and Training said: The draft Decree was developed based on inheriting the relevant regulations of Decision No. 244/2005/QD-TTg and Joint Circular No. 01/TTLT-BGD&DT-BNV-BTC, and at the same time adjusted and supplemented many important contents.
Expand the scope of application: The new draft Decree applies to all civil servants and employees (including probationary, probationary, contract) at public educational institutions in the national education system, except for institutions under the Ministry of National Defense, the Ministry of Public Security and key agencies.
Adjust the preferential allowance level according to the profession:
- Preschool teachers: Increase allowances from 35% to 45% in favorable areas and up to 80% in areas with particularly difficult socio-economic conditions, to accurately reflect the level of complexity and work pressure.
- Teachers at pre-university schools: Increase allowances from 50% to 70%, equal to teachers at ethnic boarding schools, ensuring fairness for similar tasks.
- School staff: Add first-time allowances, at a rate of 15% for support and service positions (library, clerical, ...), 20% for shared professional titles (accounting, healthcare, ...), and 25% for professional titles, to recognize their important role.
facility for determining allowances: Decision 244/2005/QD-TTg determines the allowance level mainly based on the level of education, type of school and work area (land and mountainous areas/islands/deep areas/ remote areas). However, the new draft Decree determines the allowance level based on the group of job positions (support, general expertise, professional titles) combined with school level, school type, public area.
More detailed regulations on how to calculate allowances: Decision 244/2005/QD-TTg stipulates that allowances are calculated based on salary levels according to leadership position allowances, seniority allowances exceeding the framework (if any). The new draft Decree stipulates more specific calculation methods, including the reserve difference coefficient (if any) and the calculation for unpaid employees according to coefficients.
Supplementing regulations on the period of time not to receive allowances: The new draft Decree clearly lists cases that are not eligible for allowances such as working and studying abroad to receive 40% of salary, period of continuous suspension from work for 1 month or more, period of leave to receive social insurance benefits (except for illness, maternity), other leave exceeding the regulations
Supplementing regulations on applicable provisions: Draft Decree adds detailed regulations on allowances in cases of secondment, receiving many types of allowances or many allowance levels in the same Decree (only receiving the highest level), changing the classification of administrative units, working at schools with many levels of education, working inter-school, teaching at many schools, and non-pedagogical staff participating in teaching at pedagogical schools. These provisions are not clearly stated in Decision No. 244.
The draft decree not only overcomes the inadequacies of the current regulations but also shows the deep concern of the Party and the State to the contingent of teachers and educational staff. The promulgation of the Decree will create a legal corridor for localities to implement policies in a synchronous and fair manner, contributing to improving the quality of education, retaining personnel and promoting the sustainable development of Vietnam's education sector.
The Ministry of Education and Training (MOET) said that it has published a draft Decree regulating preferential allowances according to occupation for civil servants and employees in public educational institutions on the Ministry's Electronic Information Portal to collect comments according to regulations.
