Pursuant to Clause 2, Article 7 of the Regulations on the organization and operation of primary schools, secondary schools, high schools and general schools with many private-level schools issued with Circular 40/2021/TT-BGDDT, the members of the school council are stipulated as follows:
1. The school council of a private high school is the school's management organization, exercising the right to represent the investor and related interested parties, responsible for organizing the implementation of the investor's decision.
2. Composition of the school council:
- The members of the school council of a private high school include representatives of investors, members inside and outside the school elected by the investor conference, decided according to the capital contribution ratio.
- The members of the school council of a private not-for-profit school include representatives of investors elected by investors, decided according to the capital contribution ratio; members inside and outside the school. The school's members include members who are of course Party secretaries, principals, union chairmen, and secretaries of the Ho Chi Minh Communist Youth Union; elected members who are representatives of teachers and staff elected by the school's delegation conference or plenary conference. Members outside the school are representatives of leaders, managers, educators, businessmen, and former students elected by the conference of delegates or the plenary conference of the school.
- The school council has a chairman, secretary and members. The term of the school council is 05 years. The number of members of the school council is small, at least 05 people, the maximum is 15 people.
3. Procedures for establishing school councils:
- Based on the composition of the school council as prescribed in Clause 2, Article 7 of the Regulations issued with Circular 40/2021/TT-BGDDT, the investor conference or owner decides on the number of school council members; sends or elects representatives of investors and members inside and outside the school; elects the school council president; makes a proposal to the competent authority as prescribed in Point b, Clause 3, Article 7 of the Regulations issued with Circular 40/2021/TT-BGDDT to issue a decision to recognize the school council and the school council president.
- The Chairman of the People's Committee at the commune level decides to recognize the school council and the Chairman of the school council for primary schools, secondary schools and high schools with the highest level of education is junior high school; the Director of the Department of Education and Training decides to recognize the school council and the Chairman of the school council for high schools and high schools with the highest level of education is junior high school. The school board secretary is appointed by the school board chairman.
The school council and the chairman of the school council of a private high school invested by a foreign investor approved by a competent authority to establish a school will decide to recognize the school.
- Every year, if there are changes in personnel, investors or owners will meet to submit a proposal to the competent authority to decide to recognize the addition and completion of the school council.
- Private high schools that have a board of directors are responsible for converting the board of directors to the school council as prescribed in this clause within 06 months from the effective date of this Circular.
4. Duties and powers of the school council:
- Resolution on the strategy, vision, development plan of the school, submitted to the investor or owner's conference for approval;
- Propose on the regulations on the organization and operation of the school, submit to the investor or owner's conference for approval;
- Approving the plan to organize the school's apparatus and issues related to the organization and personnel of the school based on the principal's proposal; recommending the addition, dismissal, and removal of members of the school council; proposing to recognize, dismiss, and remove the principal and vice principal of the school, submitting to the investor or owner's conference for approval and submitting to competent authorities for consideration and recognition decision;
- Approving the school's education plan; supervising enrollment activities and organizing the implementation of activities according to the school's education plan;
- Supervise the implementation of the school council's resolutions, the management of the school's finances and assets and the implementation of democratic regulations in the school's activities.
5. School council activities:
- Regular cases council at least 03 times a year.
- The school council meeting is recognized as valid when there are 3/4 (three quarters) or more members of the council, including the school council president.
- If necessary, when the principal or more than 1/2 (one of two) of the members of the school council propose, the chairman of the school council shall convene an extraordinary meeting to resolve issues arising in the process of performing the duties and rights of the school. The school council can meet in the form of a written request for opinions. The University Council invites representatives of other components to attend the University Council meeting when necessary.
- The resolution of the school council is approved and takes effect when at least 2/3 (one-third) of the members are present. The resolutions of the school council are publicly announced throughout the school.
Accordingly, it can be understood that the Chairman of the University Council is the head of the University Council, the person holding the highest leadership position in the governance structure of a private school elected by the conference of investors or owners among the members of the University Council, and recognized by competent authorities.
