Proposal to supplement regulations on reissuance of diplomas and certificates in cases of force majeure
The synthesis of opinions, acceptance, and explanation of comments on the draft Circular promulgating the Regulations on diplomas and certificates of the national education system is being consulted by the Ministry of Education and Training (MOET).
The Ministry of Education and Training said that it has received comments from 72 units (24 Departments of Education and Training, 37 higher education institutions, 6 Ministries, 5 units under the Ministry).
In the comments, the principles of management, granting of degrees and certificates are of interest to ministries and branches.
Contributing opinions to the draft Circular, the Department of Education and Training of Da Nang mentioned the provisions in Clause 2, Article 3.
The Department of Education and Training of Da Nang said that currently, the regulation only allows reissuance in cases of errors by the issuing agency, meaning that learners who lose or damage will not be reissued. However, actual management shows that there may be cases: The granted person damages or loses the degree or certificate due to objective reasons (accident, fire, accident...), or needs to re-verify the original information when there is a reasonable request for re-issuance, with verification.
Accordingly, the Department of Education and Training of Da Nang proposed to supplement the above opinion: Maintain the principle of "one-time issuance": to ensure legality and avoid fraud but expand reasonable exceptions in some cases with specific verification.
Also contributing to this content, the International University (Ho Chi Minh City National University) proposed as follows:
Propose that the drafting agency consider adding regulations covering special cases such as damage and unexpected loss (incident, fire, theft, loss due to data conversion). The proposed content is as follows: "Documents and certificates are issued once, except in cases of reissuance due to errors of the issuing agency or cases of loss or damage due to force majeure and force majeure being verified according to regulations".
In the above contents, the Ministry of Education and Training agrees with the comments, if for the reason of losing the degree or certificate, learners are granted a copy of the degree or certificate from the original book; and the degree, certificate or a copy of the degree or certificate from the database still ensures the rights of learners.
Proposal to open access to diplomatic data for commune-level agencies
Regarding Clause 1, Article 4 of the draft Circular: The authority to grant degrees is implemented according to the provisions of the Law on Education, the Law on Higher Education, the Law on Vocational Education; the Department of Education and Training of Da Nang proposes:
- Supplementing instructions on decentralizing access to database of diplomas and certificates for commune-level agencies to ensure feasibility in practical implementation.
Also contributing to this content, the International University (Ho Chi Minh City National University) proposed as follows: Propose specific references to the provisions of the Law on the authority to grant degrees and certificates or clearly stipulate the authority according to previous Circulars such as Circular No. 21/2019/TT-BGDDT.
