On November 19, Mr. Do Van My - Principal of Kim Thuy Primary Boarding School for Ethnic Minorities (Kim Ngan Commune, Quang Tri Province) said that after receiving the decision to sanction administrative violations from the People's Committee of Quang Tri Province with a total amount of 196.5 million VND for 3 violations, the school has sent a report to the People's Committee of Kim Ngan Commune to reflect the actual situation.

According to the report, Kim Thuy Primary Boarding School for Ethnic Minorities said that it is currently unable to balance the budget to pay the fine. The school's operating budget since the beginning of the year has been mainly allocated by superiors, only enough to serve regular activities according to regulations, without separate revenue sources.

The school also stated that the school's collective kitchen only serves boarding students, not a business kitchen, so there is no source of income to cover the cost of fines.

On the same day, a representative of Kim Ngan Commune People's Committee confirmed that they had received a report from Kim Thuy Primary Boarding School for Ethnic Minorities. After receiving the dossier, the Commune People's Committee transferred the dossier to relevant departments and specialized offices for research, review and propose appropriate handling options according to its authority, ensuring compliance with legal regulations.

Can be complained within 90 days

Dr. Lawyer Dang Van Cuong - Head of Chinh Phap Law Office said that in principle, all violations of the law must be legally responsible, if the violation is an organization, the organization must be responsible.

In case the management and management of the enterprise or public service unit allows the violation, the responsibility of the head will be considered. In this case, in addition to administrative sanctions, the relevant officer may also be considered for disciplinary action.

According to Dr. Lawyer Dang Van Cuong, Therefore, in this situation, if the administrative decision is not agreed, the school has the right to complain within 90 days or file an administrative lawsuit within one year to be resolved according to the provisions of law.

In case there are no complaints or lawsuits, the person subject to administrative sanctions is this school and must be responsible for compliance. At the same time, the authorities will also consider the responsibilities of relevant officials and the responsibilities of the affiliated unit to handle them according to the provisions of law.

Previously, as reported by Lao Dong Newspaper, on the morning of September 26, 40 students of the school had to be hospitalized for emergency treatment after meals due to suspected food poisoning. During the inspection and verification of the incident, Ms. Do Thi Hong Hue was suspended from work twice to serve the investigation and clarify related responsibilities.

The People's Committee of Quang Tri province also fined the school a total of 196.5 million VND and suspended all food processing activities in the school's kitchen for a period of 5 months.
