Circular 21/2025/TT-BGDDT of the Minister of Education and Training stipulates the regime of paying overtime wages for teachers in public educational institutions.
Total number of extra teaching periods in a school year for each teacher
The total number of extra teaching periods in a school year of each teacher is calculated to pay overtime wages not exceeding 200 periods, except for the case specified in Point b of this Clause;
In case the total number of extra teaching periods in a school year of teachers exceeds 200 periods because the subject cannot be arranged enough teachers to teach, the head of the educational institution must notify in writing the competent authority.
Total number of extra teaching periods in a school year for all teachers
The total number of extra teaching periods in a school year of all teachers must not be higher than the maximum total of extra teaching periods in a school year of an educational institution as prescribed in Clause 1, Article 4 of this Circular, except for the case specified in Point b of this Clause;
In case the total number of extra teaching periods in a school year of all teachers in an educational institution is higher than the maximum total of extra teaching periods in a school year of the educational institution because the subject cannot be arranged enough teachers to teach, the head of the educational institution must notify in writing the educational management agency under his/her management authority.
Taxes that have received remuneration or allowances must not be converted to teaching hours or reduce teaching hours to calculate overtime wages, unless otherwise provided by law.
Formula for calculating extra teaching salary
Salary for one regular lesson of preschool and general education teachers = (Tous salary of 12 months in the school year/Norm for one year's teaching hours) x (22.5 weeks/52 weeks).
Salary for teaching a particular period of university or college lecturers = (Tous salary of 12 months/one-year teaching hours) x (one-year teaching hours are calculated according to office hours/1760 hours) x (44 weeks/52 weeks).
Salary for one extra lesson = Salary for one regular lesson x 150%.
The Circular stipulates that the time to pay teachers' overtime wages is implemented after the end of the school year. In case teachers retire, quit, are transferred, or are transferred, the payment of overtime teaching salary will be made at the time of the decision to retire, quit, be transferred, or are transferred by the competent authority.
In addition, the time for teachers who do not directly participate in teaching but have completed enough teaching periods according to the prescribed norms is included in the total number of teaching periods in the school year of teachers, including:
Teacher's time on other tasks assigned or transferred by educational institutions or competent authorities (except for tasks that have received remuneration);
The time a teacher is sent to train or foster by a competent authority without directly participating in teaching;
The time is calculated to complete the full number of standard teaching periods according to the provisions of law.
Circular 21 takes effect from the date of signing, September 23, abolishing Joint Circular No. 07/2013/TTLT-BGDDT-BNV-BTC dated March 8, 2013 of the Minister of Education and Training, the Minister of Home Affairs and the Minister of Finance guiding the implementation of the overtime salary regime for teachers in public educational institutions.
The payment of overtime wages for teachers in the 2024-2025 school year is still implemented according to the provisions of Joint Circular No. 07/2013/TTLT-BGDDT-BNV- BTC.
