Proposal to reclaim land from 11 Khanh Hoa enterprises that do not pay land tax

Khanh Hoa - 11 enterprises were proposed to have their land reclaimed due to failure to fulfill financial obligations regarding land.

Khanh Hoa Provincial Tax Department has sent a report to Khanh Hoa Provincial People's Committee on the results of tax debt collection in August and debt collection measures for the following months.

As of August 31, 2024, the total tax debt in Khanh Hoa is VND 1,480 billion (excluding settled debts including debt forgiveness, adjustments due to errors, and pending exemption and reduction), an increase of VND 71.7 billion compared to December 31, 2023.

The tax arrears from 2023 that have not been collected are over 1,000 billion VND (the Tax Department has enforced collection). The tax arrears arising in 2024 that still need to be collected are over 477 billion VND...

In August 2024, the tax authority collected and adjusted to reduce VND 10.4 billion in tax debt from 10 out of 48 large debt enterprises.

Of these, 2 enterprises have paid all their tax debts, namely HP Hospitality Nha Trang Company Limited and Hoa An 1 Stone Company Limited, with a total amount of 8.2 billion VND; 2 enterprises have adjusted their tax debts down by 636 million VND and 6 enterprises have paid part of their tax debts to the State budget by 1.5 billion VND.

Khanh Hoa Provincial authorities requested the Khanh Hoa Provincial People's Committee to direct relevant units to carry out land recovery procedures for 11 enterprises due to failure to fulfill financial obligations regarding land as of August 31.

For example, Cam Ranh Marina and Resort Club Joint Stock Company (216 billion VND); Tan Tien Textile Joint Stock Company (24 billion VND); Phu Hung Phat Company Limited (14 billion VND); Trimet Nha Trang Joint Stock Company (9 billion VND); Tropical Nha Trang Company Limited (72 billion VND); Invest Park Nha Trang Company Limited (7.7 billion VND); Khanh Hoa Minerals and Investment Joint Stock Company (94 billion VND)...

For all 11 enterprises mentioned above, the Tax Department has taken coercive measures to stop using invoices and notified the legal representatives to temporarily suspend their exit.

The tax authority has also sent a document to verify assets of 8 enterprises, namely Cam Ranh Yacht and Resort Club Joint Stock Company, Tan Tien Textile Joint Stock Company, Nha Trang Tropical Company Limited, Invest Park Nha Trang Company Limited, Cam Ranh Wood Processing Joint Stock Company, Nha Trang Green Seafood Joint Stock Company, May Viet Company Limited, Khanh Hoa Minerals and Investment Joint Stock Company and is waiting for verification results; currently carrying out asset verification procedures for Trimet Nha Trang Joint Stock Company.

Granitvina Company Limited has been forced to revoke its Business Registration Certificate; Phu Hung Phat Company Limited is directly managed by District 11 Tax Branch (HCMC), so the Tax Department will send an official dispatch requesting District 11 Tax Branch to take further enforcement measures after the expiration of the enforcement period to stop using invoices (July 21, 2025).
