The Hanoi City People's Committee has just issued a document directing the implementation of the Conclusion of the inspection of planning management, land, construction order, and environmental protection at Tu Liem Industrial Cluster.
Accordingly, the Chairman of the Hanoi People's Committee assigned the People's Committee of Bac Tu Liem District to review the collective and individual responsibilities for the shortcomings and shortcomings in land use management, construction order and environmental protection at Tu Liem Industrial Cluster (stated in Inspection Conclusion No. 484/KL-TTTP-P2 dated January 25, 2024).
Request the People's Committee of Bac Tu Liem district to inspect, review, and prepare documents to handle construction works and items that violate construction order as stated in the conclusion according to the provisions of law.
Thoroughly handle violations of construction order of Hoang Vu Company Limited according to the records established by the People's Committee of Bac Tu Liem District according to regulations, rectify construction order management work, and prevent recurrence of violations.
The Chairman of Hanoi assigned Bac Tu Liem District to be the leading unit, coordinating with the Department of Planning and Investment, Department of Natural Resources and Environment, Department of Finance, City Tax Department, and relevant units to inspect and review the entire process of formation and implementation of investment in the form of BOT according to legal regulations on investment, land, construction and the process of water exploitation and business of Groundwater Exploitation Company 1 - Ministry of Agriculture and Rural Development (now the Water and Environment Development Investment Joint Stock Company) at Tu Liem Industrial Cluster.
On that basis, report to the Hanoi People's Committee a plan to completely remove the problem. If there is any violation of the law, it will be strictly handled according to regulations.
The People's Committee of Bac Tu Liem District presides over and coordinates with the Department of Natural Resources and Environment to inspect, review, and prepare records to handle administrative violations related to land against Son Ha International Joint Stock Company and Hoa Phong Company Limited according to regulations.
Strengthening the inspection of compliance with land laws, construction order, and environment for companies using land in Tu Liem Industrial Park located in Bac Tu Liem district, promptly detecting, preventing, and handling violations of the law.
Regarding the People's Committee of Nam Tu Liem District, the Chairman of the Hanoi People's Committee requested the People's Committee of the district to review and draw lessons from collectives and individuals regarding the shortcomings and defects in land use management, construction order and environmental protection at Tu Liem Industrial Park (mentioned in the City Inspection Conclusion).
Nam Tu Liem District is responsible for inspecting, reviewing, and preparing documents to handle construction works and items that violate construction order as stated in the conclusion according to the provisions of law.
Thoroughly handle violations of construction order by Bach Khoa Thermal Power Mechanical Company Limited according to the construction order violation records established by the People's Committee of Nam Tu Liem District in accordance with legal regulations; rectify construction order management work, and prevent recurrence of violations.
Preside over and coordinate with the Department of Natural Resources and Environment to inspect, review and prepare records to handle administrative violations related to land for Ngoc Anh Trading and Import-Export Joint Stock Company and Hoang Giang Production and Investment Company Limited according to regulations.
The Chairman of the Hanoi People's Committee assigned the City Inspectorate to publicly announce the Inspection Conclusion according to regulations; urge the People's Committees of Nam Tu Liem and Bac Tu Liem districts to organize the implementation and summarize the implementation results to report to the City People's Committee according to regulations.
Previously, the Hanoi City Inspectorate concluded its inspection of planning management, land, construction order, and environmental protection at Tu Liem Industrial Cluster. The industrial cluster has a total area of over 64 hectares, located in Minh Khai ward (Bac Tu Liem district) and Phuong Canh ward (Nam Tu Liem district).
Hanoi City Inspectorate said that there are still some problems in the industrial cluster such as construction not in accordance with approved planning, construction without permission. Some construction works increase floors, increase density, build on gardens, internal roads.
A typical example is the construction work that violates construction order at Hoang Vu Company Limited (construction that violates planning regulations, time 2022). The People's Committee of Bac Tu Liem District has issued a decision to enforce and assigned units to develop a plan to demolish the violating construction.
The inspection conclusion stated that, according to the drawings at Hoang Vu Company Limited, the 1/500 master plan approved by the Hanoi Industrial and Export Processing Zones Project Management Board in 2002, there is a 3-storey steel frame building on an area of about 240m2 (the master plan drawing does not have a cross-section showing the height of the above building).
Hanoi City Inspectorate said that in 2023, Hoang Vu Company Limited built a 5-storey house with a roof height of about 18m, which is not in accordance with the approved master plan.
In early 2023, the Chairman of Bac Tu Liem District decided to impose a fine of VND 220 million and force the demolition of the construction that violated the approved construction plan. Next, Bac Tu Liem District decided to enforce the remediation of the above construction, but to date, the enforcement has not been carried out.
