According to the Government Electronic Information Portal on April 22, the Ministry of Public Security has just responded to voters about difficulties and problems in implementing the current Residence Law.
In which voters reflected many problems related to the inability of young children to register for permanent residence, leading to not being entitled to the State's preferential policies for children such as health insurance and going to school in the current period.
A case of reflecting a long-term lease contract for old state-owned housing (each lease contract is for a term of 60 months, has been extended many times for more than 12 years or more).
Previously, when applied under the 2003 Residence Law and the 2013 Residence Law, tenants of old state-owned houses were allowed to register their permanent residence at the rental address.
However, when the 2020 Residence Law comes into effect, the agency handling the residence registration cannot resolve the permanent or temporary residence registration for children because there is no opinion from the state-owned housing management agency on whether or not to let newborn children register for permanent residence at the rental address with their parents.
From the specific cases mentioned above, voters requested the Minister of Public Security to consider and direct the overcoming of difficulties for agencies to register residence for citizens according to the Residence Law, to ensure the legitimate rights of the people.
Responding to the above recommendations, the Ministry of Public Security said: On November 26, 2024, the Government issued Decree No. 154/2024/ND-CP detailing a number of articles and measures to implement the Law on Residence (replacing Decree 62/2021/ND-CP dated June 29, 2021) effective from January 10, 2025.
Accordingly, the content of Article 7 of this Decree has resolved the permanent residence registration for the minor registration for the first time. In this case, the regional police do not need to verify "legal accommodation" and have "reality of residence or not"; Where the father and mother of the minor have a household registration, the minor is registered for household registration (do not require the house with a red book yet, whether it is inheritance ...).
In the coming time, the Ministry of Public Security will continue to coordinate with relevant ministries and branches to advise and propose to the Government to amend and supplement legal documents on residence registration and management, in which to resolve and overcome existing problems related to the first registration of residence for minors.
At the same time, it is recommended that relevant agencies and departments adjust regulations on health insurance policies, school visits, etc. to avoid dependence on residence registration, affecting the rights of minors.
