The Ministry of Home Affairs proposes to replace the Decree regulating staff streamlining

The Ministry of Home Affairs has just sent the Ministry of Justice a dossier to appraise the draft Decree replacing Decree 29/2023 regulating staff streamlining.

Authorized by the Minister of Home Affairs, Deputy Minister of Home Affairs Vu Chien Thang has just signed a Report on the draft Decree to replace Decree No. 29/2023 dated March 6, 2023 of the Government regulating staff streamlining to the Ministry of Justice for appraisal.

The Ministry of Home Affairs said that in Conclusion No. 137 of the Politburo, the Secretariat on the Project to rearrange and reorganize administrative units at all levels and build a model of organizing local government at both levels has requested to "ending the use of non-professional workers at the grassroots level (commune, ward, town)".

In Conclusion No. 155 of the Politburo, the Secretariat on the Project on a number of key tasks that need to be focused on implementing the reorganization of the apparatus and administrative units from now until June 30, 2025, requested "urgently promulgate a regime and policies to support part-time workers at the commune level".

For the above reasons, the Ministry of Home Affairs said that there should be a strong enough policy to resolve the policy for part-time workers at the commune level who retire immediately when reorganizing commune-level administrative units.

In addition, Article 64 of the Law on Social Insurance 2024 (effective from July 1, 2025) stipulates that the condition on the mandatory social insurance payment period to receive pension benefits is 15 years or more.

Accordingly, it is necessary to amend the conditions related to the mandatory social insurance payment period to enjoy the early retirement policy in Decree No. 29/2023 accordingly.

According to the drafting agency, the Draft Decree consists of 3 Articles, including: Article 1 on amending and supplementing a number of articles of Decree No. 29/2023, Article 2 on the effective date of implementation and Article 3 on the responsibility for implementation.

The draft Decree was developed on the basis of inheriting Decree No. 29/2023 and has amended and supplemented a number of the following contents: Subjects implementing the staff streamlining policy; principles of staff streamlining; How to determine salaries to calculate staff streamlining allowance; staff streamlining regimes and policies; funding sources for staff streamlining policies and the responsibility for implementing this policy.
