Ministry of Home Affairs answers questions about civil servants' retirement benefits

Civil servants over 59 years old and with 39 years and 11 months of insurance contributions are eligible to retire and receive pension according to regulations.

Mr. Nguyen Duc Canh, born in 1965 (Lam Dong), is an official at a public service unit in Lam Dong province.

Mr. Canh has 39 years and 11 months of social insurance participation; of which the number of years working in a place with a regional allowance coefficient of 0.7 is 17 years and 6 months.

He has not received severance pay, one-time social insurance benefits, or demobilization benefits.

"Can I now resign immediately according to the provisions of Point b, Clause 1, Article 2 and Clause 1, Article 7 of Decree No. 29/2023/ND-CP?" - Mr. Canh wondered.

Regarding the reflection and recommendation of Mr. Nguyen Duc Canh, the Ministry of Home Affairs has responded on the Electronic Information Portal.

According to the content of the Application and Commitment Letter dated November 22, 2024 of Mr. Nguyen Duc Canh, born on October 1, 1965, as of November 30, 2024, he was over 59 years old and had 39 years and 11 months of insurance payment, of which the number of years working in a place with regional allowance system 0.7 was 17 years and 6 months.

Accordingly, he is eligible for retirement pension according to the provisions of Point b, Clause 1, Article 54 of the Law on Social Insurance 2014 (amended and supplemented in Clause 1, Article 219 of the Labor Code 2019).

Therefore, he is not subject to staff streamlining as prescribed in Decree No. 29/2023/NDCP but is subject to retirement pension as prescribed in the Law on Social Insurance 2014 (amended and supplemented in the Labor Code 2019).
