Mr. Quoc Viet (District 7, Ho Chi Minh City) learned that in Circular 08/2013/TT-BNV, at Point d, Clause 1, Article 3, it states: "For cases where salary has been increased ahead of schedule, all achievements made before the date of the decision to increase salary ahead of schedule within the period (6 years and 4 years) specified in this Point will not be counted for consideration of increasing salary ahead of schedule for the next time."
Mr. Viet hopes the Ministry of Interior will explain and give more specific examples on this issue.
Regarding Mr. Quoc Viet's reflection and recommendation, the Ministry of Home Affairs said: The regime of regular salary increase and early salary increase is specifically guided in Circular No. 08/2013/TT-BNV dated July 31, 2013 of the Minister of Home Affairs guiding the implementation of the regime of regular salary increase and early salary increase for cadres, civil servants, public employees and employees (amended and supplemented in Circular No. 03/2021/TT-BNV dated June 29, 2021 of the Minister of Home Affairs).
In particular, Article 3 of Circular No. 08/2013/TT-BNV stipulates the regime of early salary increase for cadres, civil servants, public employees and workers.
Point d, Article 3 of this Circular clearly states the determination of achievements to consider early salary increase due to excellent achievements.
For example: Mr. Nguyen Van A, was promoted ahead of schedule due to his excellent performance in performing his duties from level 3, salary coefficient 5.08, senior specialist rank (code 01.002) to level 4, salary coefficient 5.42, senior specialist rank from January 1, 2010.
On August 1, 2010, Mr. A was awarded the Third Class Labor Medal by the President for his work achievements in the period 2005 - 2009 (Mr. A's achievements signed after January 1, 2010 were considered for early salary increase next time).
According to the regulations of the agency or unit where he works, those who have been awarded the Third Class Labor Medal are considered for a salary increase 12 months ahead of schedule. However, according to the regulations, two consecutive salary increases ahead of schedule are not allowed in the same grade, so Mr. A is still only considered for a regular salary increase from grade 4 to grade 5 of the senior specialist grade from January 1, 2013.
By January 1, 2015 (after 24 months of holding the 5th level of the main specialist rank), if Mr. A meets the conditions for early salary increase due to his excellent achievements in the main specialist rank, Mr. A's work achievements during the period from January 1, 2010 to December 31, 2015 (including the achievement of being awarded the Third Class Labor Medal on August 1, 2010) will be considered for early salary increase.
Also according to the Ministry of Home Affairs, in the case of Mr. Quoc Viet's question in Ho Chi Minh City, the organization and implementation of policies for cadres, civil servants and public employees in Ho Chi Minh City is under the authority of the City People's Committee.
